Hi there, apologies if I cover content already posted about. I have been trying to read the newbie stickies and make sense of them.

I have received PCN- notice to keeper (I know I can appeal on this basis #2 )
BUT Period parking was only 6min. could I use grace period instead

even if the reason was Parked on a single yellow line.

The question is Should I appeal as keeper and later when receive POPLA that it was 6min only so grace period apply. O use all in first letter?

    PPC? what is stands for?
  • Private parking company.

Go to the NEWBIES section and have a good read of it
  • PPC = Private Parking Company/Parasitic Parking Company

Other more experienced posters will also recommend using multiple appeal points but only at the second stage of appeal and only if the PPC is a British Parking Association Approved Operator Scheme member.

Have you already sent off a first appeal? There is an initial appeal template in the newbies thread that should be sent to the parking company in the first instance. Do not modify it.
  • No haven't yet as wasnt sure if to add bit about grace period to appeal.( template #2)
  • And the name of the PPC is.......................
  • its National Parking Enforçement..
I have parked for 6min on library "private road" with no parking no waiting sign ( which I discowered later"
I have taken pic of all signs now ( not sure how to attached them here as I am on mobile phone). so unable to type the link.

Edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper, who are two different people. ;)

Do this before you do anything else!

Then, read the sticky thread for NEWBIES before sending the appeal template you will find there.

After that you need to read up on what to do if/when it is rejected.

You should however always complain to the landowner, and your MP about this unregulated scam.

    Many thanks for your help.
So the keeper made on line appeal using template in sticky notes which obviously was rejected.
Keeper prepared for second stage of appeal BUT no POPLA code was issued in rejection letter (which was emailed rather than posted).

Please find content of the rejection letter.

    Issue date: 06/09/2018
Thank you for your appeal received on 25/09/2018 regarding the above detailed Parking Charge Notice. We have reviewed the case and considered the comments that you have made. This appeal has been considered in conjunction with the evidence gathered by the photographic evidence and parking attendants notes (where applicable). Our records show that the notice was correctly issued as your vehicle was parked in breach of the Terms and Conditions of Parking.

As you have not provided details of the driver we are pursuing you as the registered keeper under POFA 2012. Parking on this roadway i subject to a red permit or a blue permit, maximum 2 hours, being displayed as stated by the terms and conditions (please see attached). As no permit was displayed the Parking Charge Notice was issued correctly and therefore we are unable to accept your appeal.

There is clear signage at the site located along the road. Our signs meet and exceed the standard requirements and have been audited and approved by our ATA. We are contracted by the landowner to monitor, manage and issue parking charge notices to vehicles that have parked outside the advertised terms and conditions at this site.

As we are contracted by landowner to manage this site we have the right to pursue payment in our name and the amount charged is a contractual charge.

The photographic evidence can be found online (https://www.parkingprotection.co.uk), by clicking 'pay a parking charge notice' and entering the PCN reference number and VRM. Please note you can view the images without paying the charge.

The decision in the Parking Eye v Beavis case has been handed down by the Supreme Court on 4th November 2015. The judgement confirms parking regimes which impose charges where motorists overstay or breach the terms of their contractual licence to park are enforceable charges. The summary to the judgement can be found herehttps:// https://www.supremecourt.uk/cases/docs/uksc-2013-0280-press-summary.pdf

We are therefore unable to cancel the Parking Charge Notice as it was issued correctly. We have now extended the discounted payment period by 14 days to allow you time to pay the discounted settlement amount. Please now make payment of £60.00 to reach us by 30/10/2018 or £100 to reach us by 13/11/2018. We must advise you that once the discounted settlement rate passes it will not be offered again.

Payments can be made by cheque or postal order made payable to National Parking Enforcement Ltd. Please ensure you write your Parking Charge Notice number clearly on the reverse. Please do not send cash through the post. Payment can be made using a debit or credit card by calling the automated payment line on 0333 0066292. For our full Complaints Procedure please visit https://www.parkingprotection.co.uk.

If you wish to contest our decision, please send your representations to https://www.theIAS.org within 21 days from the date of this letter. Please note that if you wish to appeal to IAS the reduced charge will no longer be offered and the full charge will be outstanding if your appeal is not successful. IAS will not consider any appeals if payment is made. Please allow 12 hours from notification of rejection before appealing to IAS.

Keeper prepared for second stage of appeal BUT no POPLA code was issued in rejection letter (which was emailed rather than posted).
You won't be getting a POPLA Code as NPE are IPC AOS operators. Their second stage appeal process via the IAS is not worth considering. Read the NEWBIES FAQ sticky, post #3 to read why.

So it's time to just ride this out - maybe some debt collector letters, possibility of a court claim (but you'd be their very first), they have 6 years to pursue.
