Dealing with family debt

  • The problem is we can’t be living with the fear of opening the door. We did call police and they said they couldn’t do anything. I even called a lawyer but he couldn’t help. And I know about that if they take something you can receiver with a receipt but how can I get a receipt from 6 years ago or things that we’ve had for many years - that’s why I need advice on how to deal with this :(

If this person is operating within the law they will identify themselves and allow you to investigate.

If they won't do that then you must insist that the police attend

You must not continue to pay them or this will never end

When you've found out more detail - what debt is this, who owes it, what legal stage is it at - post again

You do not have to pay them anything, and if they attempt to take items in future you need to provide recipts to show they are your possessions, not his. SO, DO NOT let them in.

This is probably the crux of the matter. Looking around my room right now, if I had a knock at the door right now, I could not prove ANYTHING in my room belongs to me. There are no receipts.

Most of us don't have receipts for our belongings.
  • They are bailiffs - the debt is for my brother I know exactly what is for but he isn’t in the country. They had a court paper. I thought these forums where here for advice and what I need is advice on how I can get these people to stop coming. Is there anything I can do? TIA

If they ARE bailiffs, who are they from?

What did the 'court papers say?'

What does it say on the receipts you got in exchange for the payments?

If they return, and you again open the door, you must tell them that the person they are seeking does not live at the address, and give them his address in China if you have it.

Tell them that you have been advised not to discuss the matter any further, and if they will not go away, you must phone the police and ask them to attend immediately. If the police say they cannot attend, tell them there is a breach of the peace and they will be required to attend.

You should also contact whoever is mentioned on the receipt and tell them that the money was obtained from you under false pretences and you require immediate repayment.

Do not under any circumstances pay them any more money. It is not your debt.

If they do return, I would film the entire proceedings with your camera phone.

You simply refuse them entry, they cannot break in, then deal with the matter by post with their head office.

If you have already allowed them in, then they can return at any time without permission to enter.

But you should still complain in writing to the head office of the bayliff company.

  • He wouldn’t go and he had his leg in the door and I called the police but they wouldn’t have done nothing... it’s a hard situation because at the end of the day it’s mine and my parents stuff in the house even though they don’t live here permanently but the way the bailiff see it is anything in that house could belong to him. We are not opening the door at all anymore but it’s just a sad time :( thank you everyone

If I lose the plot and let a balliff into my house for a debt that isn't mine, I can't see them legally being allowed to do so as they wish.

As long as the court writ is still valid, and the bayliffs have previously been in the house, then they can force entry again should they wish too.
The only way to properly challenge this is in court by getting the judgment setaside as they have the wrong address for the debtor, or provide evidence to the bayliffs that you are not the debtor.
