I received a claim form even I had a DMP with equivo of £1/month. I’m expecting this thing to happen so need a few advise from the group
1. The amount I need to pay increased because of the court & legal fee. If the ccj was successful do I need to pay the court & legal fee in full or they could be waived due to affordability?
2. How do I send the claim form because there was no return envelope?
3. Do we have a thread, forum or contact number helpline for me to understand how to fill up the claim form?
4. Can someone advise me do I need to send more docs before the ccj or judgement would be finalized after I admit the full amount?//tksnota

Looking for some advice please. Started a self managed DMP around 18 months ago. Did a lot of research before doing so and feel I have a good understanding of it however I have an outstanding issue.My biggest unsecured debt is with the same provider as my mortgage. The mortgage is completely upto date and I’m having to contact them every few months to apportion my payments fully to the mortgage instead of the unsecured. I haven’t paid anything off the unsecured debt in all this time and each time I’m forced to call to sort the apportioning out of course they want to speak with my about the unsecured which I decline to do. They apportion my payments as I direct and continue to contact me by letter regarding arrears on the unsecured.My credit file reports it as in arrears and they are yet to default it continuing to charge interest. With the recent and likely continuing interest rate drops I’m thinking I can pay them the difference in drop of my mortgage onto my unsecured. However I ideally want them to default it and that hasn’t happened yet. Do I sit tight, paying them nothing and hope they default soon so I can deal with them like others or do I write asking them to stop charging me interest in the interim?

How long has it been since you stopped payments?
As they are your mortgage provider, I would be tempted to try a different tack.
Write to them and explain your intentions, you can be more candid with them as you will still have your mortgage relationship with them, tell them what your plans are, and what you would like them to do to help ease this situation.

Thanks for responding. It’s actually been 20 months having just reviewed my credit file since I made a payment to them on the unsecured. I’m not sure whether that’s been skewed every few months due to their inability to apportion my payments which as mentioned I have to request they correct approx quarterly.When you say explain my intentions do you mean for me to explain I’m willing to start paying the difference due to interest rate drop as it’s affordable because is it or actually say “look I’m not interacting with you about the unsecured until you default me?”
It seems blatantly obvious to me they have no intention of defaulting it given it’s been so long but can I force their hand? It’s a large amount so I’m conscious of more stringent action but all they have done for 20 months is send me arrears letters, nothing stronger at all. You can probably deduce the type of non lender I’m dealing with here given the mortgage type.
Whole thing is very frustrating and somewhat disconcerting when everyone else has played ball so to speak

I’m new to the process. Cancelled my DD’s (loans and credit cards) and recently missed the first of many missed payments 😁 so starting to get emails and calls etc. I’m just wondering, can DCA’s come to my home, or is that just for Council tax debt?I read a post on another page recently about just not paying these companies at all, as apparently they’ve already been paid out by insurance - is this correct? Is there any option of not paying them whatsoever if I don’t care about my credit score?And if I do pay them back, at what point will this be, do I contact them once defaulted or wait for them to contact me again? What if they go to debt collection without defaulting first? Sorry for all the questions, it’s all a little confusing! Thank you so much ☺️0 -
Hi There,
So i have been on here a while. My aim is to now save. My Debts have defaulted so interest is paused etc. So i have lowered my DMP payments from 100 to 48 pounds a month. I have also gone to self managed for PRA via their website. I understand i have to pay debts, But as they are defaulted right now. I may as well have a good quality of life for 6 years until defaults disappear and save some.
Now one creditor has not defaulted. I hope this makes them too.
My question is, can creditors reject the new payment and take legal action etc.0 -
