    Hi all, Quick update - I've gone self managed via the Nedcab site (much recommended, its fab!) - most offer letters have been replied to accepting offers, a couple with no answer (but they will get the payments I proposed anyway!) - and for anyone with Avant credit, I have been struggling to get anything from them - and this week my offer letter was returned by the Post Office saying they were no longer at their address (their UK registered office!) I know they have been having issues - looks like they have gone...... Not quite sure what to do now but will save their monthly payments incase anyone pops up for it. Any other advice?

    Sorry to ask again, I'm just not sure what to do...
    They have recently offered an 80% reduction on the balance I owe if I can pay it by mid-November. At first I thought YES RESULT but I want to check the wording to make sure everything is kosher...
    If you pay £166.93 today or by November 16, 2018 we will accept this as full and final settlement of your loan and your account with us will be closed.
    If you accept this settlement offer and pay the agreed amount by the date stipulated , we will mark the debt as 'partially settled' on your credit file. This shows future creditors that the debt was cleared for less than the full amount. Please be advised that this may impact your ability to obtain credit. The account will be removed from your credit file six years after it was partially settled, or six years after the date it defaulted if this was earlier.
    1. Does this seem above board?
    2. They haven't mentioned anything about other companies chasing me for the debt, is that bad?
    3. Is partially settled okay?
    4. They emailed me the offer, is that satisfactory for 'written confirmation'? That seems to be their only method of communication!

    Firstly, well done - that's a really good offer:T

    1. It looks a pretty routine letter.
    2. You'll want something a little more concrete and in writing (or email) - see below.
    3. Yes partially settled is okay, it'll still drop off your file in 6 years from the default date.
    4. A few companies prefer to use email as a means off communication - so just make sure you keep the email and take a printed copy for your records.

    Now to the F&F acceptance part, there is a template on the NEDCAB site which you could modify, but in essence you want to make it clear that you are prepared to accept their offer on the clear understanding that neither they or any associate company will take any other action to enforce or pursue the debt in any way whatsoever and that you will be released from any liability (this part is taken from the NEDCAB template).

    Other that that it looks like you've got yourself a good deal.

    Good to hear it's all going well and it sounds like you've got everything in hand. As for Avanti Credit - I'd just do as you suggest. Hold onto their payments and see what comes your way next. They may simply have moved their UK RO - or maybe they've sold your debt on. Who knows, but keep an eye on your credit file in case anything pops up there and sit back and wait. It'll allow you to build up more of an EF by not paying them anything until you hear from them,.

    thanks :) Yep, I don't think there is much more I can do - its about the 5th letter I've sent and not had replied to also - so I've tried! I cant find anything about them on google etc related to closing, but sure someone here mentioned they were having problems a while ago. Will squirrel the money away for when someone gets in touch, as I am sure they will!

    Hi thanks for the reply, Problem is when i include her income the offers generated are higher as they include her income. The debts are only in my name so she should not have to pay towards them right?

    I put in my DH's contribution to the joint bills as his income. So the whole mortgage, utilities, phone, food are in there, with his 'half' of these being his income. It's my DMP and he's not included in it otherwise.

  • Hi all just after a bit more advice if anyone can help please. My self managed DMP is going along ok so far. Have reached an agreement with Barclaycard and also MBNA who have both been extremely helpful and had no problems in accepting my offers and freezing interest. Tesco Bank are being very slow in replying and they are also calling me everyday around 3 or 4 times a day and the calls are getting earlier. Today they started calling at 8am. I made it clear in both my letters I would only deal with them in writing and I also messaged them via their Facebook messenger and reminded them of this. I was then told they have put a stop to the calls until they receive my offer of payment but they are still calling. Just wondering if it was worth making a complaint about the calls again. Also I first wrote to them at the beginning of October and have since found that on the 19th October they added interest onto my credit card. I do have a letter dated from the 15th October saying they would give me 30 days to sort out my finances so I assumed that interest would stop. I was just wondering what other people's advice would be? Let them carry on as they are or should I write ad complain? Thanks.

    If it were me, I would complain in writing to Tesco, about how they are contacting you by phone when you have previously withdrawn your consent, and how it constitutes harassment. :)

    Follow W2Ls advice - but I would also add to the letter a complaint about their breach of the 30 days grace period and I'd add a sentence to say that if they continue to contact you in any other form, other than in writing, that you will be taking the matter to the Information Compliance Office. That should grab their attention and if it doesn't - follow through with the complaint to the ICO listing all the times they've called you and copies of your communications asking them to stop.
