All our creditors (we have 27 in total) have accepted the new payment amounts. All except Robinson Way (Hoist). We have 4 of our accounts transferred to them. They have said that the original amounts were contracted to be paid and that they will accrue the difference from the new payments each month and then they will eventually default us. I have raised a complaint as we don’t have a contract with them and I don’t understand what they mean by contractual payment. . Just wondered if anyone knew if Robinson way can actually do this? Thanks for any help

First off, to avoid confusion, you are the debtor, they are your creditors.
Is Robinson way (Hoist) still charging you interest ?
The reason i ask is this, there is a tendency nowadays for creditors to sell on bad debt accounts, without defaulting them, so in effect the new owner inherits all the rights and privilages the original creditor had, so they can still charge you the min contract payment every month, charge interest etc.

Thanks for the reply. Robinson Way are not charging any interest and the original creditors did not default us. You may be right in what you are saying. They have told us that the contractual amount is the amount that they agreed with the original creditors. If it’s correct then I guess there is nothing we can do.0

Well yes there is, you should write to Robinson way and ask them to clarify the debts status, it’s a bit unfair on you, as if the account was defaulted, they would accept a much lower payment, you are been penalised because of this.

Link are notorious for not responding to these things and why would they bother - seeing as you have continued to make payments. They never acknowledged receipt of my CCAs, but because I stopped payment at the same time I sent off the CCA request - they eventually replied with documents which subsequently turned out to prove the debts as enforceable. But that took over 6 months or so.
My advice therefore is to stop making any further payment to them, and if they write asking why - remind them of your CCA request and that in accordance with sec77/79 collection activity should cease until they provide you with compliant paperwork. There is no need to chase them for it - they've had the request and they know it.
At this point I would go self-managed and get the paperwork you've been sent checked out to see whether it proves those accounts are enforceable. You can go on the All About Debt forum and they will help with that. I'd stop all payments in the meantime and do as you say - let those ones know you are suspending payment while you seek advice on the documents you have received. They know the drill.
Just a quick update. I had 4 of the CCA's checked on the AAD forum and have been advised they are all unenforceable! :j
I will be emailing Payplan tomorrow and telling them we will be self managing from now. Once done, i will stop making payments to Link and await their response re CCA's.

Thank you sourcrates. I have sent a complaint to Robinson Way so I will see what they come back with. I don’t see why they can’t accept the reduced payments and they are only slightly less than the previous payments anyway. Just seems a bit unfair and I have told them this and that we are committed to paying off the debt. I did have a successful complaint via the financial ombudsman regarding another creditor that refused to stop interest which the ombudsman found my favour, so may try this route again if Robinson Way don’t play fair with this. Hi Guys,
well this is my first post & to be honest I am not in a good place the moment (completely down to my own actions I know)
I am currently paying into a DMP and have around £7000 left on this (Paying £190) per month.
I have had pretty bad issues with gambling which I am now getting under control with the help of my wife.
I have stupidly taken on extra credit which I am also now repaying in a reduced payment plan directly with the creditors.
I get paid around £1800 per month and currently only coming out with around £400 for myself which helps support my family.
I have a wonderful wife & 5 year old son but to be honest feel like the worst Dad & Husband possible getting myself into this mess & my family are the ones losing out.
I am up to date on all payments and not just ignoring the problem but at this moment with the amount of debts and working 40 hour weeks without anything to show for it cant really see things getting better any time soon.
I have not wasted any money or gambled for several months now so for that I am happy and know that eventually things will get easier.
Last few weeks have been the hardest and have been at my lowest points I can remember and close to doing some silly things but I know I need to be here for my little boy & my wife.
Well, to be completely honest not sure what I was hoping to achieve by posting this but just needed to get this off my chest as dont like to worry my wife with these things as I have done enough damage.
Anyway hopefully can keep carrying on and getting my debts reduced and hopefully can starting giving my family what they deserve.

My total debt is just over £15000 (£7000 in a DMP) the rest I am managing privately)
We are living in a housing association home which is rented.
To be honest nice to just get it off my chest, I am currently in agreed repayment plans with my creditors but feels a hell of a long way to being debt free !
