  • I just wanted to check something with you. Are you going to be delaying the start date of your SM DMP to allow you time to build up a reasonable Emergency Fund (EF)?


    Yep, having read a lot of the other posts on here, I am definitely delaying to build an EF :)

    I just needed a bit of advice. We dropped to token payments last August for a number of reasons or boiler replacement and massive car bill, anyway we decided to go SM at this time and leave SC. We also put in CCA requests at the same time. Anyhow, we have 2 debts with 1 DCA; one in my name and one in my Hubby's. My debt came back as enforceable so I upped the payment although the hubby'scame back as unenforceable so we've left that on token payments....the DCA have tried to contact my husband over last couple of days and he will answer when convenient as he doesn't mind speaking to them, however he's not sure what to say. Does he just say we are keeping them on token payments due to the debt being unenforceable or is this showing our hand? I'm confused. Thanks

    Hi Sylvester6,

    You do realise that for the unenforceable debt, you need not pay another penny? Your husband has the option of withholding further payment for that account as they have not been able to provide you with compliant paperwork. The other option is to use the fact that the account is unenforceable to make a ridiculously low settlement offer, if you feel so inclined... :)

    Hi Willing 2Learn, thanks for your quick response. Yes we are aware we don't have to pay them anything and are planning to keep them on a £1 until we're in a position to offer a low F&F. I know we don't have to offer them a settlement but would prefer to eventually and then close the account properly rather than it hanging over us. I just wasn't sure what to say to you them!!

    Personally I wouldn't 'say' anything - rather, you should write and tell them that you will be withholding payment while you focus on your priority debts. They know the drill so that won't come as a surprise and it's always best to keep things in writing so you have an audit trail if ever you need it.

    Tokens are a waste of time and won't really make them behave any differently. I've not paid PRA for quite some time now and they send statements on a relatively regular basis, and those statements offer varying amounts of discount. Like you I don't intend to fully walk away from UE debts, but will close the account with an F&F when the time comes.

    Thought I would pop in and say thank you for all the posts and information, it's been a great help!

    I've my own diary going but am moving from a paid DMC to SM with all the letters going out to confirm this.
    Mortgage started 2020, aiming to clear 31/12/2029.

    So angry...things were just starting to look up, with companies getting back to me and accepting or at least acknowledging my DMP....and BANG!

    Turbo has gone on the car!

    Was due to start payments on July 1st, how angry will they be if I ask to move date to September? So far I've made no payments...do I continue to not pay, but update them all?

    Don't worry about your creditors being "angry". You just need to do what is right for your individual circumstances.

    Looking back at your posts, you only started looking at a SM DMP via NEDCAB back in April. It has only been one month delay so far. If it were me, I would delay the whole thing by six months so that you can sort the car and get a reasonable EF (Emergency Fund) saved up. That would mean writing to your creditors, letting them know what has happened, and giving them a new start date in October. As long as you keep them 'in the loop', they will have to be satisfied. It also increases the chances of your creditors defaulting your accounts, which is a good thing as it freezes the interest. :)

  • well, after everyone defaulting me, except creation, and me complaining to FOS, they have sided with creation. is there anyway i can force creation into defaulting me? DMP started in june last year through stepchange.

    Only avenue left open to you now is to stop paying them, although they could continue to be stubbon and sell the debt on undefaulted, chances are they will, eventually, default you, but there are no guarentees in life, the consumer credit sourse book only issues guidelines for this sort of thing, there is no rule that says they have to default you.
