Can a landlord take a holding deposit on a property he doesn't yet own ?

    When we viewed the property there was a "sold" sign outside the house. He told us that all the paperwork had been signed and they were just waiting for the solicitors to do their stuff and transfer the monies across. This was the 23rd of July. When we spoke yesterday he said that the process had been slowed down as the vendors had been on holiday and then the solicitors had been away also. Had I known it would drag on for so long I would not have given a deposit and looked for something else. We were given the impression that it would all be sorted by middle to end of August, but he's now saying that he never gave us a definite moving in date which is true, but I still feel I was a little misled.
