Highviee Parking Tesco Silverburn Please help!

Help and advice needed.

My mum received a letter yesterday from Highview Parking with a fine for parking I tesco silverburn for 2hiurs and 58 minutes. This has distressed my disabled mum quite a bit and she is panicking about getting into trouble and wants to lay the fine.
I took my disabled mum to Tesco silverburn on the 1.9.18. We couldn't find a disabled bay and was driving around for about 20 minutes to try and find a space so parked in a normal bay and displayed her blue badge. We went to Tesco and took our time as its not our local one. we even went for a cup of tea in their cafe.

I don't know what to do I think it is a scam but don't want to have to pay the larger fee if it is not paid before the 29th September. The letter date was the 13th September but it only arrived yesterday.

Any help or advice would be greatly appreciated.

    Tesco have a big problem with their parking scammers
    which can only lead to them losing business. Trouble
    Tesco has, is they have no idea how many customers
    shop elsewhere now

    We have suggested customers write to the CEO, but of
    late he has passed such complaints to his so called
    executive staff who are now SUPPORTING the scammers
    and now hold money paying customers in complete contempt

    No harm in you complaining to the CEO and let's see what
    reply you get. It's normally a copy and paste letter telling
    you all about parking abuse ... total rubbish

    If this is Scotland do not admit, or even hint, at who was driving. You are safe to ignore Highview if you want.

    You are complaining to Tesco which is an absolute must do. If you feel you must engage with Highview then there is no harm in sending the template contained in the thread at the top of this board that tells Newbies to read it first. Do not alter it if you wish to send it.

    Silverburn is renowned for over use of its car parks so there is a real problem and Highview employed to keep the spaces moving. You’ve been caught my ANPR, but Highview have no idea who the driver is and under Scots Law, require this in order to pursue payment. As there is no Keeper Liability, so let the ‘discount’ Period expire and look out for the next 5 ‘begging letters’ all entreating you to pay up.. the Blue Badge argument is of little use, as this is Private Property and the badge technically invalid.

    Tell your mum there will be further correspondence but to pass it on to you. You simply open and keep it stored carefully. Tesco do not own the car park, so complaining to them is invariably pointless. It would be needless busy work - Highview know they are on a hiding to nothing in Scotland so leave them well alone. They soon will lose interest.

    By all means complain to Tesco but do not identify the driver and ignore Highview's rubbish.

    If that isn't productive, also consider contacting EASS to see if they will pick-up on Tesco's failure to provide a reasonable adjustment:

    Do remind Tesco that they are jointly and severally liable with Highview for this and the penalties they can face for this are significant.

    Also remember that the Blue Badge has no validity on private property - It is the Equality Act that applies here and that applies to all suitably disabled people, regardless of badge, or even dedicated space. Again, those markings may ape the TSRGD but they still have no legal meaning in a private car park.

    If Tesco will not overturn it, then do an online appeal to Highview (even though it is Scotland and there can be no 2nd stage POPLA).

    Along these lines:

    Dear Highview,

    I am the registered keeper of this car but was not driving, and the driver will not be named. I am fully aware that you cannot hold me liable as registered keeper, since the location is in Scotland.

    The driver took me to Tesco Silverburn, and we were slower than able bodied shoppers, because I have a mobility condition (Blue Badge attached as evidence). I am disabled under the meaning set out in the Equality Act 2010.

    We couldn't find a disabled bay and were driving around for about 20 minutes to try and find a space, so the driver parked in a normal bay and displayed the blue badge. We went to Tesco and took our time as its not our local one.

    We even went for a cup of tea in their cafe, as (due to the effects on my daily living - extreme fatigue and pain caused by my medical conditions, if under physical and/or psychological stress) I need to rest when going about such day to day activities as shopping at large retail stores.

    We have complained the Tesco Dundee (Head Office and CEO) about this 'charge' automatically issued by ANPR, which is a system that actively leads to indirect discrimination against people like me with protected characteristics. You and Tesco Silverburn are jointly and severally liable for indirect discrimination by not offering more time for disabled people 'at large'.

    It is not an excuse or justification in law, for Highview to say you didn't know about my condition and disabled status, when it comes to the wider offence of indirect discrimination.

    Should you fail to cancel this charge now you 'know' about my disability, you and Tesco will also be liable for 'direct' discrimination, against me as an individual disabled person who is legally entitled to a reasonable adjustment of time.

    Indeed, when confirming you have cancelled this unfair charge, please confirm that you have also added my VRN to your store White List at Silverburn (due to my Blue Badge status) and also add my VRN to the White List at xxxxxx which is my local Tesco, as I do not wish to go through this stress from you ever again.

    Kindly confirm all of the above has been done, to allay my alarm and distress.
