Should neighbours offer compensation to my tenants?

I own a ground floor flat which I rent out to very good tenants. The owners of the first floor flat want to go into the roof to extend. There will scaffolding, builders in the common hallway etc
We are trying to lay some boundaries as to how this work should proceed. One thing I am not sure of is if I can expect the upstairs owners to compensate my tenants financially for the inconvenience.

  • What exactly will be your tenant's inconvenience?

    No I don't think you can expect your tenants to receive any compensation. Is this your idea or have your tenants contacted you to ask you to negotiate for some compensation. If the latter, compensation for what exactly?

    Are the neighbours entitled to do the work, or have they had to "compensate" you to allow them to go ahead? If the former then I don't think any compensation comes into it, neighbours will occasionally cause a bit of disruption. The boot might be on the other foot in the future.

    So if you both have share of the freehold what agreements have you come to over your neighbours altering the building that belongs to both of you. Surely there is room for negotiation for your tenants in there somewhere?
  • All someone who is living next to/near building work is object to prevent it.

    Otherwise everyone living next to someone putting a new kitchen in, or making any kind of alteration would be putting in compensation claims. This just doesn't happen.

    As a half freehold owner who presumably agreed to the work, you could offer to reduce the rent, or let them move out if they can't deal with the work. But as long as weekends are free of noise and it just happens during normal working hours, it won't be pleasant but shouldn't be too bad.

    Give the tenants an idea how long the work will go on for.
  • As you are a joint owner of the freehold, presumably you have agreed to the works and been involved in the planning?

    So as joint freeholders, you would normally jointly own the loft.

    If that's the case, you will make a chunk of cash by selling a lease on your share of the loft to your neighbour.

    If you want compensation for inconvenience (for your tenants or yourself), you should decide how much, and negotiate that into the sale agreement.
  • If I was your tenant and this was proposed, I would be moving out as soon as any work was confirmed.

    No realistic amount of financial compensation would make me suffer my way through building work - especially as I work from home and it would compromise my ability to earn a living. It was bad enough when neighbours did building work and I was out of the house 8am-6pm. Nowadays it would be a non-starter.

    If I was your tenant and this was proposed, I would be moving out as soon as any work was confirmed......
