Electoral Roll and tenants

Hi
Previous tenants moved out without notice and without giving a forwarding address. During the refurb prior to new tenants, bailiffs called looking for the previous tenants. I told them that they had left and that I didn't know where they were but, if I found them, I would pass contact details on to the bailiffs.
I have been told that the bailiffs intend to visit my BTL again. I've searched the Electoral Roll and the scumbags are still recorded as living at my property. Who do I need to contact to have the electoral role corrected?

Don't think this is going to solve your problem, however, will give you the answer you need. This is an excerpt from a borough council's website and the link is provided below.
Q. My ex-partner is running up debts against my property, how can I get him/her removed from the Register?
A. You can't. A person can only be removed if they personally write to us and ask us to remove their name, or when they re-register (under rolling registration) with another Authority, that Authority will notify us to remove their name. If they fail to do either then when the annual canvass form is sent to your property in August/September, you should cross out their name and when the new register is published on 1st December their name will not be listed against your property.

Thank you for the reply. I have found an email address for the Electoral Registration Officer and have written to him this morning. I'll check again in December.
If anyone knows how I can find the scumbag ex-tenants I'd be interested.

You could always write to the council pretending to be the tenants and just give their new address as an empty property you know of.

This is definitely not the case for all councils - in our last rented place, my OH and I were getting debt collectors turning up for other people on the electoral roll at the house, so we phoned our council and they were quite happy to make sure that no one apart from us was registered as living at that address.
I'd simply suggest getting in touch with the Electoral Roll officer for your local council and asking them to resolve the issue, as you already have done, George.0 -
the debt has probably been taken out at that address though, so ot will be the first port of call anyway.
just tell the bailiff that you own the property and that the people they want have left. They have no grounds to re-visit once they know this. If there's a letting notice board up (or in the window) then if they tried to force entry with police present, they would be expected to contact the number shown. If they don't you can report them for theft I would think, or at the least sue for damages.
They probably don't believe you, which is why they might be coming back. Just tell them to stay away.0 -
bailiffs need proof that you are who you say you are, and so, i suggest you show them your purchase completion statement if they appear again, to prove you are the owner. or if they turn up when the new tenants are ensconced, production of a tenancy agreement in the new tenants names should discourage them from coming back.0

The easiest way to deal with the ER issue is for the new tenants to deal with it. They will want to register themselves on the ER anyway.
All they need to do is to contact the local electoral officer (at the Council), tell them they've recently moved and get the relevant form. They may even be able to download the form from the Council website.
It simply asks you to list all those who are at the property and eligible to vote, so they just list those currently at the property and the changes should be made.
In addition, you might want to ask the Council about the "annual canvass", whereby they send out a form automatically to all householders showing those currently on the register. They are required to do this by law.
When the new tenants get that form (depending on when it's issued) they should complete it by crossing out the names of anyone no longer living at the property and adding their own names.
If the form has already been issued and not returned e.g. by the old tenants then their names are usually removed from the register, as they've failed to confirm that they are still eligible to remain on the register.
Annual confirmation is generally needed to remain on the ER, so the old tenants should drop off eventually. But the new tenants may be able to speed this up.

I found an email address for the Electoral Registration Officer. I had a reply today as follows:
I have checked our current details relating to this prop. and their names were removed in May. We are due to publish the new register on the 1st Dec. and I can assure you that we have this prop. down with a different elector.
Result!
