There was definitely a post that specifically said a mate had bought it.

No i said had offered me full price i paid for it but i email shop first and they were happy to refund it so it's gone back and i bought a more suitable dive so hopefully no issues, there was a post but it got wiped, i just pointed out that saying it was second hand was as helpfull as a wet paper bag, given this is a Consumer Rights forum not a forum for pointing out the blooming obvious.
I guess someone didn't like my post and reported me and it was removed.

Anyway still don't know what the legal side is on this but as i say PicStop were decent enough to come to my rescue,

You've been told the 'legal side'. If you've paid full price for the replacement hopefully when it arrives it won't have been pre used by someone else and therefore be second hand.

More to the point, if you receive a product in future without packaging I hope you don’t complain - as you’re happy to return a product without it and expect a refund
