Dwelling as open market

Hi,

I have been keeping an eye on a property that may be coming up for sale and I have just found on the planning website an application for this property registered last month.

LAWFUL DEVELOPMENT CERTIFICATE (EXISTING) FOR THE USE OF DWELLING AS OPEN MARKET DWELLING

What does this actually mean please?

    Isn't there a clue in the rest of the papers, or the previous consents? Probably that it was formerly restricted to some sort of affordable housing or tied to an employment use, and they now want to sell it as a "normal" house.

    The house has restricted occupation such as only to be used as a holiday with limited lets or an agricultural property that can only be occupied ny someone connected to an agricultural purpose.

    The planning application is to remove that restriction to allow it to be marketed openly without the restriction

    If it's accurate, it will mean that the council has been asked to remove the restriction imposed when planning was originally granted, allowing anyone to buy.

    This request may have been made because the former use is no longer relevant, or, more likely, because the occupants have lived in the property unchallenged and in breach of the legal restriction for 10+ years. After this time it will no longer be enforceable.


    It's usual for the granting of a Certificate of Lawful Development to add substantially to the value of the property.
