Speeding ticket - manned equipment??

Hi all,

Today I received a speeding fine from manned equipment in a temporary 50mph zone due to road works. The NIP states I was going 66mph and caught by manned equipment, it says i was travelling at this speed on the 07/09/18 and received the fine today... What should I do? It’s asking me to send my details, can I avoid this fine? I recently lost my job and have already been on a speed awareness course over a year ago.

    You haven't been fined yet, fill in details as required and return.
    No, you can't avoid it.

    Why would I send my details back if I haven’t been fined yet? Surely I should just tell them nothing so I don’t get a fine? I can not afford it I have no job...

    If you tell them nothing, you will get 6 points and a much higher fine.

    If you're lucky it'll be a fixed penalty - 3pts and £100.

    If you try and get out of it you could be looking at multiples of that

    Whatever the numbers, the penalty for not returning the NIP with the details required is bigger than the penalty for speeding.
    Tall, dark & handsome. Well two out of three ain't bad.

    Send the form back and you get £100 and 3points.

    Don't send it back it's 6points and up to £1000. Plus your insurance will be hiked for that offence too.

    As our American cousins would say you do the maths.

  • You haven’t received a fine. What you have is a Notice of Intended Prosecution (a “NIP”) and a request for driver’s details (a “Section 172 Notice” so-called after the part of the Road Traffic Act which provides for it). The requirement on you is that you need to respond to the S172 notice within 28 days of it being served on you. It is deemed served two working days after it was posted. Look at the date on it, add thirty days and it needs to get back to the return address by then. If you received it today it should be returned by (roughly) 12th October. What actually happens next is largely up to you.

    Scenario One (the silly route): You can choose to ignore the notice it if you wish. You will then receive notification of court action under Section 172. Since you seem to have no defence to the charge (you have received the notice and you know who was driving) you will face a fine (assuming you plead guilty) of a week’s net income. Since you have no income the court will use a default minimum of £120pw. You will pay a surcharge of 10% of the fine (the minimum is £30) and £85 costs. So, a total of £235. Your licence will be endorsed with six points and an endorsement code – MS90 – which will see your insurance premiums rocket for up to five years

    Scenario Two (the sensible route). You can return the request for information in time. The speed alleged qualifies for a fixed penalty of £100 and three points (with a much more insurer-friendly SP30 or SP50 endorsement code). Within a short while of sending in your details you will receive the fixed penalty offer. When you get it simply accept the offer by sending in your £100 accompanied by your licence. (Do not forget this. If you do your £100 will be returned and you will face - much more expensive – court action).
