They can stipulate as much as they like, and often do. S75 is onerous on them. That's why the courts are there and sometimes it's necessary to start a legal process (having given fair warning) to enforce your rights.PRAISETHESUN wrote: »Keep in mind that a s75 claim will only get you your money back, it will not get the job done any faster.
You can get damages, which could be more than your money back. You have a duty to mitigate your losses so could be entitled to less back.
In this example, if an equivalent worktop is available now and from a different supplier, then one option is to tell B&Q this and require them to source and fit it. If they don't, then you could take over the job and claim under S75. It's unreasonable to have these protracted delays.0 -
For what its worth, B&Q will refuse any liability of your workers starting before delivery of all the goods. Theyre well aware supplier issues can leave them open to liability so cover that in there terms and conditions.
Such terms and conditions aren't always reasonable and wouldn't necessarily stand up. Everybody knows you can't get workmen at the last minute. So if you're expected to rip out your old kitchen against a date that B&Q keep missing, then I don't think they could rely on their T+Cs.
Lawyers love drafting T+Cs that they know wouldn't/mightn't stand up. Hence severance clauses.0 -
My daughter had a similar issue with a B@Q kitchen bits missing for a few weeks , hers were doors. She wrote to B@Q about the issue and received a £200 gift card back , plus all the doors were eventually delivered .This is a system account and does not represent a real person.
