    You should complain then to the BPA about the fact that you've submitted your appeal to Smart (did you do it online?), they have not responded with a decision on your appeal and have engaged debt collectors to harass you which is in conflict with the rules of the BPA Code of Practice. Write to Steve Clark.

    And even if they show a rejection letter they 'say' was posted, you do not pay this PCN. Debt collectors are to be ignored (see post #4 of the NEWBIES thread for links & confirmation that DRP are pointless pen-pushers).

    I have only the original PCN letter and the data recovery plus letter received today :( It's been so long since I put the appeal through that I had almost forgotten about it.

  • I received a response from Steve :) much faster than anybody else I ever email.

    Unfortunately he is away for a few days but has asked a colleague called Emma to look in to the matter for me.

    A very welcome sigh of relief from myself, It feels much better to be getting progress.

  • Good news, I received a response from Smart Parking today who have cancelled the Parking Charge Notice.

    This response comes coincidentally a few days after I contacted Steve at British Parking Association ;)

    That's more than just a coincidence. Steve Clark will help where he can (notwithstanding that his salary is paid by the parking industry to represent them).

    Yes, a good outcome but one wonders, why are Smart not being sanctioned by the BPA for their failures to deal with appeals properly and the repeated reports of them going straight to debt recovery letters.

    Possibly the fact that they are the second highest contributor to the BPA pot?

    We have brought this to Steve Clark's attention previously, but I guess there's only so much that can be done in the face of a juggernaut bearing down on you!

    Also having issues my self not sure if anyone can help? I went over by 22 minutes due to car park being grid locked on the day but hadn't realised I went over.
    I had moved house a week before, forms had been sent to DVLA but all the letters went to my old house and have only recently been picked up! So the debt collectors have sent a letter and smart parking aren't willing to acknowledge the issue I have. Any advice please? (Store manager is calling me tomorrow but not sure if I should try anything else)
