JSA, new style ESA and UC

Do you still receive the extra disability premiums if you claim *new style* ESA on UC.
In full service UC area.
Currently on IB JSA with 1 week left on extended sickness (13 week sick note).
Wil have enough NI conts to be on contribution based ESA if that’s of any relevance these days.
In receipt of enhanced PIP for living and standard for mobility.

    As you're claiming 13 week extended sickness were you found fit for work for ESA and are you waiting for a Tribunal hearing or MR decision?


    To be able to claim New style contribution based ESA then you need to have paid enough NI contributions in the previous 2 tax years.

    Still on JSA(15 months) and never been on ESA, haven’t even claimed ESA yet as still in hospital, will the 13 weeks on extended sickness prior to claiming ESA/ UC enable to have a medical assessment immediately for ESA/UC?

    As you have been claiming Income Related JSA for this length of time then you won't be entitled to claim any Contributions based ESA because you wouldn't have paid enough NI contributions in the previous 2 tax years.


    What you'll be able to claim will depend on what's in your area. If it's a full UC area then you won't be able to claim Income Related ESA, it will have to be UC. Check here. http://ucpostcode.entitledto.co.uk/ucdate

    Thought the qualifying years(NI Conts) to claim are 2015-16 and 2016-17 so please advise if I’m wrong with those years. Cheers.
  • I believe you are correct and would be entitled to ESA conts.
    I do not believe you get premiums on a contribution based claim.

    That is correct. If you were working up to 15 months ago you should be OK.
    Making an application for new style ESA will automatically start the Work Capability Assessment procedure. You want be able to improve your income by also claiming a UC but that will depend on your circumstances. The ESA will only give you £73.10 for 13 weeks followed by £110.75 if you are put in the Support Group. If not in the Support Group you stay at £73.10.
