    Yes, now seems a good time to send a s 77-79 CCA Request to Cabot.

    When Mortimer Clarke write to you (which they should) you can respond with a copy of your CCA Request to Cabot letting them (MC) know the current situation especially if Cabot can't comply.

    If Cabot cannot comply with your request within the statutory time-frame then the debt becomes unenforceable in court until or unless they do comply.

    If nothing else that would place you in a better bargaining position if you want to settle.

    In my experience when Cabot cannot comply with a CCA Request they tend to write back and tell you that they can't comply (yet) and put the account on hold.

    I would also send a Subject Access Request to Cabot to see what that reveals about the offer from Marlin which you accepted and paid.

    I would still like to settle really just to get rid of it once and for all so is it worth offering a full and final and what % should i start at?

  • I have now received a letter from Mortimer clarke and this gives me the option on there to request further details like the credit agreement, so i have sent this back as well as the SAR and CCA request that have already gone out

    They also enclosed a statement of account which confirms the payment in December 2014 so i just need to argue that i paid it under full and final

    Am i ok to put the credit agreement on here to be checked if they send one back?

    just wanted to update here

    Cabot have today informed me that due to the settlement payment payment in 2014 they are now closing my account. Such a relief for me
