Does anyone have any experience/advice how I can claim back the cost of installing a drop kerb/vehicle crossover, after being sold a house that said it had a driveway, though it didn't have a dropped kerb, which means that the driveway is illegal?........ The estate agents property details, stated there was a driveway and included a photo with a car on the drive. One of the forms which the solicitor asked the owner to fill in, the owner stated that there was a driveway. I also had a full survey for the property before purchasing the property and it didn't state the driveway was not legal/there was not a drop kerb............ Thank you in advance for your help.

Which law(s) do you think the driveway is violating that makes it illegal?
Caveat emptor! You were sold a house that was advertised with a driveway and the house has a driveway. If you want a dropped kerb then you will need to apply to the council and pay for it yourself.0 -
When you stepped up the kerb to view did you not notice?0

Did you pay extra for this non existent driveway as well. By that I mean was the house more expensive than it would have been if there hadn't been offstreet parking at all?
You can't claim for this because the house you bought did not have a driveway because there was no dropped kerb. It is up to you to check that a house has everything you want before you buy it.
The council may not give you permission for a dropped kerb. It will depend on their policies. If you can't get a dropped kerb you will not be able to cross the pavement to get to the drive.0 -

Sorry, I know this is terrible but that did actually make me laugh out loud. :rotfl:1 -
There's a house across the road from me that's just been sold with a driveway but no dropped kerb. It's a double driveway and there is a bloody lamp post in the middle of it :eek:I’m a Forum Ambassador and I support the Forum Team on the Health & Beauty, Greenfingered Moneysaving and How Much Have You Saved boards. Is there or is there not a driveway? My guess - yes there is.
Is there or is there not a dropped curb? Clearly not, but who if anyone told you there was?
Did you view the property? A dropped curb (or lack thereof) is hardly hidden from view.0 -
Where did the seller lie?
They were asked if they have a driveway, they do ie a paved area/road leading from pavement to house.
The fact you cannot legally put a car on the driveway and this is what most people use them for, does not change the fact there is a driveway.0
