    The general line is that it is 12.07% but my employer uses 12.069%.

    I was the one who said it could be as low as 12.04%. That's because the 12.07% is worked out on the basis of a year being a straight 52 weeks during which you have 5.6 weeks holiday. But you can say that 365 days is 52.14285714285714 weeks!

    When you were offered the bank work, what hourly rate did they quote? Is that what you are being paid?

    Yes it’s complicated to explain but in essence I’m paid ( pro rata) the same as I would be salaried full time.

    No; its either work or unpaid leave

    Does this mean that where, for example, a full time salaried employee would be paid £10 per hour, you would be paid £11.21 per hour?

    No, sorry I’ll try to explain. In short I’m paid the same per hour as any other employee on my banding.

    My role is split between two bands; but I’m actually paid more for band 4 work, than band 5- due to length of service.

    Indeed the issue is they are suggesting I’m not owed any holiday.

    Just a quick update: direct from HR - "Bank staff do not accrue annual leave"


    I've sent a few links which will hopefully persuade them otherwise. Had a quick chat with ACAS just to confirm I'm not going mad, which they confirmed

    Oh dear! Someone hasn't been keeping up to date with the law. Or NHS contractual terms. I wonder how many people they owe money to?

    Indeed; I’m genuinely surprised if I’m the first person who’s questioned this.

    Whether other have simply accepted or what, but there are a lot of Bank workers at this trust, so we’ll have to wait and see what happens.
