Iam disabled and my husband is my full time carer and been refused by hmrc to get the 30hours free because neither of us can work.We are entitled to the 15hours free of childcare for our 3 year old.Please help as this is discrimination. Help us?

    It isn't discrimination at all.

    The whole point of the free 30 hours is to help working people afford childcare but, as neither of you work, you don't need it.

    You can usually get 30 hours free childcare if you (and your partner, if you have one) are:

    in work - or getting parental leave, sick leave or annual leave
    each earning at least the National Minimum Wage or Living Wage for 16 hours a week - this is £125.28 if you’re over 25

    I cannot see any discrimination, and you do not qualify for thirty hours free childcare. It should be possible for your husband to care for you as well as look after the little one. That's what he will have to do in the school holidays as well. It won't always be easy, but it's definitely possible - I had two children under two, one with severe disabilities, as well as an older child, and a husband who worked long hours. Obviously my children have grown, but I became a single mum and brought up my three children alone, initially whilst studying for a degree. One of my son's is still, and will always be, severely disabled. I'm now also becoming my mum's carer, and pop into a neighbour as well. I also do voluntary work that fits in with my caring responsibilities.


    So yes, it will be hard at times, but there is no discrimination. I don't know if you can be left alone, or whether you can look after your child for short periods, but if not, then your husband will cope.


    If you really can't cope, ask Social Services if they can help to fund further hours, but be aware that there is a limited pot of money. There could be others who are a higher priority. Also, if there is a Homestart in your area, they might be able to provide a volunteer for a couple of hours to look after your child in your own home. (If anyone is wondering, I dind't use either of these options).
