I have a participant who has Asperger’s syndrome, is currently under the legacy benefits system (n.b. this is now a full UC live area). He’s economically inactive and has not work for some time.
He currently receives PIP (£85.60/wk) and IR ESA (personal allowance £73.10, work related activity component £29.05/wk and enhanced disability £16.40/wk).
He is in the work related activity group with transitional protection. There’s no housing costs to consider as he lives with his mother. He is over 25.
My participant is very keen to start work, is undertaking some training and has requested various better off in work calculations for different working hours.
Due to his condition, and his previous employment history, it would appear that a move to full time work may prove very difficult – and that making a move into work via part time work under “permitted working” would be a wiser choice – both financially and holistically. However, he appears very keen on seeking full time work.
My question re this scenario is:
If he went into full time work (say, on minimum wage) his entitlement to ESA would end and he would get his wage plus the PIP. I’ve done the calculations to demonstrate this.
What would happen if he then left the full time job, say, because he'd reflected and found it too challenging?
My understanding is that this change of circumstances would mean he had to make a claim for UC.
What would be the process and ultimate entitlement if his circumstances were deemed to be as they were when he was economically inactive in terms of work capability, the claim to UC and any transitional payments? Am I correct in saying that if DWP accepted that he was not actually fit for work/circumstances were effectively unchanged re his capability, then he would be worse off under UC because the enhanced disability component under ESA for a single person doesn’t exist under UC?

I'm a bit confused by this as I thought you had to be in the Support Group to get the enhanced disability premium - but perhaps I'm having a brain melt.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
No, if the OP is claiming Enhanced daily living PIP (or for others reading this, High rate care DLA) then the EDP is also payable, if not in the Support Group.I'm a bit confused by this as I thought you had to be in the Support Group to get the enhanced disability premium - but perhaps I'm having a brain melt.

I think they would only get the basic £73.10 under the UC system if he stops working for at least the first three months.0
