Hi I’m new on here and wondering if anyone can offer me any help. I had an IVA with DFD 14 yrs ago I paid into the IVA for about 18 mnth then it failed due to my circumstances at the time, since it failed I joined Experian and found a ccj also a third party contacted me which I cleared and in the yrs between I’ve worked hard on my credit score. I’ve never heard from DFD which has now been taken over by Aperture. I’ve just had a successful PPI claim with YB but they won’t release the cheque to me as I was previously in an IVA? I have telephoned Aperture who say they will not have taken my case on as they only took over live cases. YB want it in writing from my IVA company Which no longer exists and there are probably no records of me, also would any monies outstanding now be statute barred? Can YB do this legally? I would welcome any advice before trying Citizens Advice or Ombudsman. Thank you.

  • If money is still owed, yes they can.

    Statute barring never changes the fact it is owed.
  • How can I find out when they are saying they have no record of me and what about the creditors I’ve paid off in the interim? I’ve checked the IVA register and my credit file is clean and has been for longer than 6 yrs.

    You are forgetting that your creditors will have written off interest and other charges as part of your IVA. Unless you paid back everything that was owed this money can still be offset against redress from a successful PPI complaint.

    Neither the CAB nor the Ombudsman can reverse your situation.
  • So is there any way I can find out who they are and what’s outstanding because like I’ve said there’s nothing on my credit file and my previous IVA company is a dead end?

    Your problem is convincing the Bank that you have no debt which means your PPI redress should go to your former IVA creditors.
    Only if you could get a letter stating "no interest" from your IVA company would you be able to surmount this. Your case is doubly difficult because your IVA company is no longer trading.

    What made you think you were able to successfully complain about PPI and receive redress personally? With former insolvency it's generally wise to let sleeping dogs lie. You are no longer being chased for any unpaid debt, isn't that redress enough?
  • I had no idea I could still be owing money having thought I had successfully cleared all my debt and nothing showing on my credit file, I’ve been reading some other posts and it looks like I could write to the trust for a letter of no interest but I won’t hold my breath after what I’ve learnt this week. Thanks for your help.
  • Whilst in my IVa and still after my IVA, there have been PPI claims that have been made, which are sent to the IVA company - i dont want it and see it as unfair they write off 60% of debt but i can still complain about PPI?

    raised an extra £3k to my IVA, makes me feel better that i have paid off even more :)

    if you looking to pursue, the only way forward will be for Apeture to write you a letter stating "no interest" as above., which by the sounds of things, will be difficult

    Did you get a certificate of failure at all, because you should of done.


    After 14 years its unlikely any records will still exist, which begs the question, how did Yorkshire bank know about the IVA ?


    After 6 years, all trace is wiped from all databases.


    These type of cases can be very complex, i would think you would have to refer to the financial ombudsman service here, they have guidance on there website about how these situations can be resolved.

    If you only paid for 18 months its likely all your debt is still outstanding, because you would of been paying the IP`s fees which would amount to a fair chunk of those payments.


    The good news for you is that your debt will be statute barred by now, so you are off the hook in that respect, i think the PPI payment would be a small price to pay for that piece of mind.
