Apoca Bristol Parkway

Hi and thanks in advance,

Car was issued with 2 parking fines in Feb and Jan at Bristol Parkway station car park, the letters arrived after the appeal period. I definitely paid for parking as I have to keep receipts for work, and have got pictures stored of receipts but not originals, these match up with bank statements proving payment. As the car is not my own and I was borrowing it - I got the number plate slightly wrong - I put an 0 instead of an O. When I first got the letters, I went on here and read some advice saying to ignore because the appeal date had passed anyway and my number plate mistake would not make a difference to Apoca. Now the owner of the car is getting letters from Zenith collections threatening to go to court. Bit worried about my next course of action, obviously this feels ridiculous as I am potentially having to pay 300£ (maybe even more) over a 0 instead of an O.

  • Zenith arent threatening court. Theyre just debt collectors.

Not a hope a court will uphold that the letter O and the number 0, which are IDENTICAL on a UK VRM, are different enough to warrant a parking charge.

APCOA (note correct spelling) don't do court, Zenith can't do court. But this isn't your case to deal with, it is for the registered keeper to handle.

Given this is APCOA, who don't take these cases very far, the RK could identify you as the vehicle's keeper on the day, which should switch the attention to you, with APCOA sending you a new Notice to Keeper (NtK) and we can take it from there with an ultimate appeal to POPLA using 'not relevant land' as the reason the keeper can't be held liable.

APCOA don't usually contest a well put together POPLA appeal.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Should have send the NEWBIES thread template appeal anyway - late or not - you had 28 days to appeal so surely you are not saying the letters took over a month to arrive, counting from the date on said letter?

Ignore APCOA and ignore debt collectors. APCOA never sue and they have no case.
