Should i report as stolen?

Hi All,
My brother has a BMW on which the gearbox failed, not having the funds to be able to afford to take the car to BMW to be fixed. There was a guy that runs a garage advertising a BMW with head gasket issues for sale. The guy wanted £700 for the car, once i explained why i was buying the car for the gearbox as i had a local guy that would remove the gearbox from the this one and put it into mine, having handdd over the £700. he then said do us both a favour and let me do the work, itll save you taking this car to the other guy and i have all the tools here to do it. Made sense so he also arranged for my car to be collected from my home address.
A full Month later and the guy still has not fixed my car, the £700 car has not moved so gearbox not taken off it, when asked where my car was he said at his mates garage but can't tell me where. I have just found that he is still trying to sell the £700 car that i have paid him for. Is this a matter for the police ? As i have let him have both cars ? I have told him that i will collect both cars but hes says that i can't because he isnt avaiable. What can i do ?

    What do you mean ' i can't because he isnt avaiable'? Go to his garage and confront him or pretend to be interested in his re-advertised car and meet him that way. Police will most likely say civil matter. If he wont return cars you'll have to take legal action.

    It might not be theft but could be fraud.

    Its not stolen, you gave him the car and the keys.

    That wouldn’t rule out theft.

    Forget about the fact you only just bought it. If the v5 is in your name, it's YOUR car. If I gave my car to a garage to do the work and then I saw them advertising it for sale - then yes I would be on to the police.

    Give the police a call on 101 and see what they say, you can't lose anything by asking them.

  • Thanks guys for taking the time to reply.
    My brother called and told the guy that unless bith cars were back at tlhis home address then he would get the police involved and reporr his car as stolen. Im hapy to say that bith cars are now sitting on his drive.

    Good result, seems daft that the garage would suggest doing the work and then get into all sorts of bother to avoid it! Still, nowt as queer as folk!!!!
