    You may never come across it at all if you are lucky in your buying and selling. Most posts on the various forums like this only concentrate on things going wrong. There have been situations outlined on here that even after running online businesses for over 20 years I've been lucky enough not to come across.

    Ebay will find for a buyer if the item isn't delivered. Attempted doesn't win a seller INR.

    As a seller on ebay, you must adhere to eBay and Paypal regardless of whether you are private or a business.

    What "various consumer rights" are you talking about?

    I'm not sure you are right, both eBay and PayPal require delivery to a buyer, not attempted delivery. I won a case earlier this summer, admittedly with a courier involved and not RM where courier did not leave a card until the third delivery attempt and only when I tried to re arrange delivery did they say I was out of attempts. Seller basically told me hard luck as their tracking showed I had not accepted delivery nor had I tried to re arrange delivery . I ended up opening an eBay case and getting a full refund when it was found in my favour.

    However, attempted delivery on a return by buyer TO a seller would be sufficient for a refund as per the law.

    I think it depends on if you get Dublin or the overseas team but we've had cases closed in our favour for attempted delivery and I've seen posts on the eBay forums where other sellers have claimed the same.

    If the buyer got a refund but then went and collected their parcel (as mentioned above) the seller does have 30 days to appeal if eBay wasn't happy with the attempted delivery to win the INR.

    The money back guarantee states that items not collected by the buyer are not covered although it's not clear if that refers to this situation or items sold as collection and the buyer doesn't turn up.

    You may get some discretion from some reps, but the refund won't come at the expense of the buyer as that is unlawful and isn't inline with the ebay money back guarantee. Any refund in this instance would have to be at ebay's expense ie. to both parties.
