    Take that link down - it identifies you, your home address, the car's VRM, the PCN details - it needs to be totally redacted.

    All that said, the quality of the scan (certainly from where I'm viewing it) is not good enough to read any text detail.

    With regard to parking time versus ANPR/car park entry time, you might find this useful from another Not so Smart case.

    The contract would be expected by any reasonable person, to begin and end at the times stated on the Pay & Display ticket purchased, as this is the 'point of sale' as confirmed in Thornton v Shoe Lane Parking 1971, where the Court of Appeal held that that the ticket machine was the offer, the insertion of money was the acceptance and any contract began at that point in time.

    As opposed to being charged and held into by an unknown contract term, from the very second the vehicle was purportedly captured by ANPR entering into the car park. No signs explained at the site entrance (as cars pass in moving traffic, Smart's remote, high cameras that they cannot even see) that the driver's time was being counted from that point and not from the payment at the machine. Why would a different time be shown on the Pay & Display ticket, if it is not the timing upon which a driver can fairly rely?


    Please don't forget to complain to your MP, and the MP where the alleged parking event took place.

    Why are we looking at a Smart Parking NTK, that we all know is always non POFA?

    I thought you were talking about a ParkingEye one to look at. There is never a need to scrutinise a Smart Parking one - doesn't need cloak & dagger links & pms.

    Smart are a cinch to beat, just by appealing with the template and waiting 35 odd days for them to cancel. EVERY TIME.

    Not even any need for any thread, no advice was needed, these are easy - except we'd like you to come back and confirm in October when they cancel!

  • I do apologise C M. but from my first post, it said smart, and already did their on line appeal before finding this forum. My next step is POPLA, hence asking for the help to get as much needed to evade the vultures.
    I wish i had seen this forum before the first stage, it probably would have already came to a stop.
