Disputing inventory that was not signed by the lead tenant

A £2000 joint tenancy (5 tenants) deposit is currently in dispute with the tenancy deposit scheme and I am currently in the process of submitting evidence over the dispute. The dispute is basically regarding cleaning and redecorating fee's which we are disputing as the house was a much bigger mess when we moved in than it was when we moved out.

The agency first issued a inventory which I as lead tenant disputed as it was completely inaccurate. Having not heard anything back, I assumed the agency simply forgot about it, but in their evidence they submitted the same inventory which was signed by one of the other tenants the day after I disputed this inventory.

Is it possible to claim the inventory which the agency is submitting to TDS is not valid as it was not signed by me (The lead tenant) or any other tenants but 1. I have picture evidence of the entire inventory in which I disputed, which includes my signature and printed name along with all the disputes that I raised.

Is the adjudicator likely to side with me and deem the inventory proposed by the agency invalid if I submit this point ?

  • An inventory cannot be 'valid' or 'invalid'. It is just evidential.

    If you can produce a copy of an email you sent at the time disputing the inventory, you could produce that as evidence.

    It also depends what the inaccuracy was about. If you were disputing the condition of the windows, but the deposit deposit is over the condition of the doors, the dispute may not be relevant.

    If one of the joint tenants signed the inventory at or immediately after check in, that will be seen as strong evidence that the inventory accurately reflected the property. After all, why else would the joint tenant have signed?


    You can of course submit any conflicting evidence.


    The arbitrators will decide what they believe the truth to be.
