Parkwatch

Hi all

I've read the newbies info but can't find anything covering my precise situation.

My parents in law have received a PCN from Parkwatch, alleging they overstayed in a short stay 'pick up point' bay outside a Tesco store on a retail park. The twist is that the registered keeper details are incorrect - they had very recently purchased the car from an employee of theirs, the PCN is addressed to him and he has passed it on to them.

I have offered to handle this on their behalf (they are elderly and not particularly savvy). Question is should I contact Parkwatch and advise them of the real keepers details (via the 'transfer of liability' section on the notice? I don't trust the car's former owner to pass anything further on if he receives it.

    if the person who received the ticket (named on it) doesnt tell parkwatch the new keepers details, then that previous owner is liable in law (POFA2012), so if anyone were to suffer in this , its that paerson named on the pcn, not your parents

    I would be telling said owner to name the current keeper with their name and address

    then that person (the new keeper) can ask you to help them to deal with it at that point

    until the previous owner does this, tthey, repeat THEY are liable in law, with a possible CCJ at the end of it (not your parents) - so as your parents are not named on the paperwork, at this point they have no liability


    as tesco customers, they could (or you could) write to the TESCO ceo direct and get it cancelled (proof of patronage etc) - its actually better if tesco cancel it than any other strategy

    Yes I would do that as if you were him. Personally I would just fill it in ''from him'' with a squiggle signature (unreadable) and give your Dad-in-Law's name but YOUR address given for their address, so that YOU deal with all the letters, and they never worry.

    Do not put his name as 'driver'. Only as the new keeper from xx/xx/18 and attach a screenshot of the V5 confirmation online, showing in his name, or a bill of sale, etc.

    A PCN or a NTK addressed to your Dad-in-Law should then arrive to your address.

    You can then genuinely tell the in-laws that you are dealing with it for them, and you will see the letters and can do the POPLA appeal in the keeper's name as if you were him/her. You will then get all emails (set up a new account just for this - in the keeper's name or a generic email name) and you will get the POPLA outcome.

    Done properly, an appeal to ParkWatch is pretty easy to win at POPLA. NOTE - NOT in your name 'on their behalf' do not tick that box at POPLA stage - do everything as if you were him.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
