Finally claiming PPI
I have finally decided to give the claiming of PPI a go after thinking I wouldn't be able to going back to the mid 90's
Sadly in the mid 90's I started having financial issues and kept going overdrawn. Eventually the bank (Barclays) advised I should get a loan to help which I was sold with PPI. Unfortunately I kept having more financial problems and needed an increased loan to resolve this. To do this the bank paid off the current loan which included PPI with another loan including PPI.
Being much younger and unwise then I didn't realise this meant I was paying PPI off with one loan then getting another loan with more PPI. This continued to a 3rd loan which again included PPI.
Now with this 3rd loan this is why I never believed I could claim as I claimed against the PPI when I lost my job. However could I claim against the first two loans as I was told you had to have the PPI as I was with the 3rd loan but since I actually used the PPI could I claim against it.
Due to my financial situation at the time I was told I would have needed PPI in order to get the loan. The timescales for these are as follows:
Loan 1 - taken out Aug 1996 - £1000
Loan 2 - taken out Dec 1996 - £1500 (£1013.86 paid off old loan)
Loan 3 - taken out Dec 1997 - £2700 (£1001.50 paid off old loan)
Claimed against the PPI of the 3rd loan Feb 1998 - May 1998
Eventually finished paying the 3rd loan in Dec 2001.
So would I have a case to claim back PPI and would this include a case against Plevin too?
What is also frustrating that I had loads of unauthorised and authorised overdraft fees during this time along with an Overdraft Protection which i never knew I had and have only just discovered now as I look at my statements. This was only pennies but the transaction shows as Service Charge 200 items at £0.80/100 = £1.60, it varied on the amount of transactions I think - I didn't claim bank charges years ago as these were all over 6 years at the time.

You can complain if you want to, no guarantee you will win the complaint.
Any win would result in a reduction based on how much you were paid out on your earlier claim. It would also impact your ability to complain given the policy did pay out something.
Plevin only applies to rejected complaints and only if the finance was in place during the qualifying period which yours wasn'tSam Vimes' Boots Theory of Socioeconomic Unfairness:

Sounds like you've still got the evidence needed to make a complaint about ppi sold in the 1990's because I doubt the bank would find it for you. Anyway, if the loans were unsecured and the quotes on your credit agreement or the first direct debit on your bank statements show that the loans were set up with single, upfront ppi premiums then you can use this as a strong mis selling reason.
Not sure about the overdraft ppi, so perhaps one of the experts on here will be able to advise you on this issue.0 -
You can have overdraft PPI yes, the figures quoted are normal for the range they charged

I always thought the claiming against it would be an issue which is why I have never done it. However I do believe in all the cases of the 3 loans I was told it was part of the loan and you had to have it. It was only when I spoke to family that I ended up claiming against it. However it was the 3rd loan this happened on.
The other part is that when the 1st loan was paid back by the 2nd loan I got some PPI back and same with the 3rd loan.
I do have agreement numbers on my bank statements so I'm sure I could quote them and I'd say I was definitely mis-sold as I was told it was part of the loan. There was no option on the form to opt out.
With regards to the Overdraft Protection fee I was never given and option of this it was automatically included with the overdraft.
It is worth claiming the worst they can say is no

Plevin came about because of a change in the law covering S140 in the 2006 consumer credit act (effective 2008). Any credit facility that ended prior to that fell wholly under the old law. Any credit facility that existed into the new period qualifies.

You can complain about single premium attached to your loans, but any redress will first have successful claim amounts taken off. Nothing saying you can't do it.Non me fac calcitrare tuum culi0
