NCP/BW Legal Court Summons

Ah, so pay £250 and have it done with or £100 and lots of paperwork and uncertainty As much as I hate to do that seems a reasonable option. Would I get my money back if I hired a lawyer or a "paid for" civil representative?0
-
A lawyer is the only person who can represent you in your absence.
You would not get those costs paid, no. CPR27 covers that.0 -
Thank you very much for all your input.0

It's incredibly rare for NCP to take anyone to court (they only did it 8 times last year) so I would suspect as soon as they see this might get complicated they won't bother trying too hard.0
-
Ahhh, I don't feel privileged at all. Can't understand why on earth are they picking on me, when I never even parked! I will call the court, explain that I will be away and ask what to do about my defence.
But thank you anyway.0 -
The court was not helpful. Looks like I don't have a choice, I can only contest the jurisdiction and pay £100,which may not be accepted, or apply to have the case stayed which also costs £100. If I start kicking up with BW Legal for evidence etc - maybe I can negotiate a settlement with them. Any thoughts?0

No chance.
Already told you stop thinking about paying and other options.
Contest jurisdiction and they will stop.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

To contest jurisdiction I would have to make an application within 14 days with full proof and pay £100 for the privilege. As this is related to a contract law and I am an EU national the court is unlikely to grant it, so I will be £100 lighter and back to square one.
I will defend the claim, give a few dates in the next 8 weeks or so that I am available and if that doesn't work, I will apply to have the case stayed for duration of my absence, either way I will have to fork out £100 to make either application. I can apply to the judge to have the application for stay fee re-paid if the case goes to court and I win after my return, and I will let BW know that they will face at least the cost of £100 plus my daily rate of pay for the court appearance. (Understand I can claim loss of earnings??)
In the meantime I will be putting together a defence and if you lovey veterans would be kind enough to look over it, I will be ever grateful and delighted.
Good night and a massive thank you for hearing me out, it has been a journey for me today.0 -
How do you work that out?As this is related to a contract law and I am an EU national the court is unlikely to grant it,
Did you read & fully understand the section about jurisdiction that you quoted above?
Do you think a parking firm will sue you in another country's court system?
I think not. Contesting jurisdiction will kill the claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
