Unaware CCJ

Good Evening. I was in the middle of getting a mortgage when my broker emailed me saying ive failed due to advise credit. I was confused has I sent him a copy of my report via... on receiving the email today I updated my report and seen that a CCJ was issued on the 28.8.2018 by County Court Business Centre. so confused so I rang them and it was issued to an address witch I've not lived in for 3 years. it was a parking company ive never even got a parking ticket etc. so let alone claim forms. ive done my n244 form. what will happen now? say good bye to the mortage ?

    If you choose not to pursue the set aside, then perhaps, at least for a while. Or go with a lender who deals in adverse credit.

    Obviously if you choose not to give up and manage to get it removed, then it would be a different story.

    oh no ill try my best to pursue as I did not get any paperwork etc if I does get aside is it a green light etc. and lenders that deal with adverse credit is this something that could be done your just gonna pay abit more etc

  • If the CCJ is set aside, your mortgage application will be in better shape, but there is no green light.

    If you go down the adverse credit mortgage route, rates will be higher.
  • They send the CCJ’s to the address your vehicle is registered with on DVLA’s records.

    So I’m assuming you’ve updated your license and vehicle registration details to your current address - if not that’s also an offence :)

    County court claim forms are sent to the last known UK address, so unfortunately, if you move and paperwork/ creditors are not updated that can be why paperwork is missed. I appreciate you wasn't aware of the ticket but that doesn't mean the ticket was issued incorrectly. When you do a set aside the court will normally assess why didn't you reply to the original claim forms, how promptly have you made the application and do you have a realistic prospect of a defence.


    A set aside can cost up to £255 to submit, but if you are on low income or certain benefits this can be waivered with an EX160. You should seek legal advice before making this application because if you submit it and it fails you can incur legal costs of the other side.


    I understand that you one of your main motivations for doing this is your credit file, so I will also add that if you pay a CCJ in full within 1 month of the judgement date (28 days to be on the safe side), then it will be removed from your credit file and the register of orders, judgements and fines. So, depending on the balance of the judgement, this could be another option (as a set aside application is not a guarantee of success). Best of luck,
