    I can't believe the Co-op are back in bed with CEL, having sacked them off a few years ago, then finding customers suddenly getting 'revenge' tickets against them, the Co-op paying them off on their behalf, which led to CEL really opening the floodgates with hundreds of further charges.

    When the Co-op finally woke up on this, they stopped paying. So, CEL issued court proceedings against 50 Co-op employees who were simply parking on the Co-op's own car park in order to attend work for the day - we never did get to hear the result of the court case (but I suspect the Co-op paid CEL off to avoid court).

    It just amazes me that the 'romance' seems to be back on.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I wonder if the 50 case one was with the Co-op whose
    shop fronts are green

    The OP said it was East of England Co-op which have
    blue shop fronts and seem to operate as a different
    company

  • The Co-Op are nto a single entity. Each area can and does have its own contracts for service. Youre presuming waaaay too much if you assume that different parts ot he same company actually talk to each other...

    They dont operate "as" a different one, they ARE a different one
    (Ive audited the one based in Farnham, more than once, I know exactly of what I speak ;))

    Interesting info, most will not know that.

    I have a co-op loyalty card from a "green shop" and last week
    in Weymouth I shopped in a "blue shop" who accepted my
    loyalty card which currently has £80 to spend on it. They asked
    if I wanted to use the credit ?

    There must be a tie up somewhere

    I suppose this might not be a stand alone Co-op store, perhaps part of a larger retail park, or it is the landlord or managing agents who've brought in CEL.

    There is of course a tie up.
    Each entity is a seperate legal entity par to fthe cop group of companies.

    Yeah I have an email trail from the Co-op store manager in which he twice says he will cancel the PCN
    That's silver bullet evidence to support a defence point at court claim stage, that says that - unlike in the Beavis case - without the authority and backing of the retailer in this case, this Claimant has no 'legitimate interest' excuse that can save it from being struck out as a penalty.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    It's vitally important that you inform CEL that their agent has instructed to cancel, and you share the email with them, as well as keeping evidence that you have sent the information to CEL.
    If you do then it will put you in a very good position.
    CEL are known for discontinuing most (but not all) claims at the last minute, adding a counter claim into the mix will mean they will not be able to drop out last minute.


    CEL as a result of their actions have caused you a great deal of stress, and worry, as well as used a huge wad of your personal time, document the time you have spent, document any evidence stress you have suffered ( ie loss of sleep etc) it all helps, and depending on how you want to play it add the Co-operative group involved into the claim as well - after all they are responsible for the actions of their agents.
    jointly claiming against the principal was recommended in the days of clamping, as the clampits would often phoenix into another company or refuse to pay up, where as the principal would be a much tighter spot

    Do not send anything to a PPC recorded/signed for, send it 1st class from a post office and ask for a free certificate of postage.
    They could very well refuse to sign /accept the delivery and from there you will be stuck.
