No. VW are marking your file contrary to the ICO guidelines. They should have marked your file as defaulted back in 2010/2011, when you were 3-6 months in arrears. If I were you, I would ask VW to amend your account to show it as defaulted back in 2010/2011...
This is my interpretation of the guidelines...I work within the voluntary sector, supporting vulnerable people to rebuild their lives.

Have a look at the thread linked below. Pay particular attention to post #4 as the guideline has been quoted there. If I were you, I would submit this to VW in writing, as a complaint. ICO stands for the Information Commissioners Office. The complaint can be escalated to the ICO if VW fail to mark the account as defaulted 2010/2011.
You would still owe the money and would still have the same duty to continue with your repayments. It is just that the account should not be visible on any of the three main credit files (Experian, Equifax & TransUnion) as the default would have been removed from you file.

UPDATE: Guys, my partner and I would like to say a HUGE THANKYOU to everyone involved in this post. Following on from last week, blood sweat tears, sleepless nights and over 12 hours of research later. We took the advice from Willing to Learn on re: POST 4 (See Above) we copied the letter and wrote to the creditor and hounded them all week (and I mean hounded)....and we have woken up to see that we have had the above completely wiped from our credit file.….This means we can now get a mortgage, something we have worked so hard to get. Thankyou all so so much....We couldn't have done it without forums like this and your feedback!! Thankyou!!!0
