DBS check help

Hi so I’ve been working at bank for last few years as temp worker but I have now been offered permanent contract.
So will need revetting -
During my time of already workin here I was at festivals in croatia and convicted with drugs intent. (Please I don’t need the it’s your own fault replies) I’ve made mistake and I just want to do all I can in life now to do well.

I was given a suspended sentence and fine in croatia.
So now my work have offered me a new job higher grade.
Do you think this conviction will show up on basic dbs check ?
Not only will I lose my job if it shows the embarrassment in my work will be worse day in my life.

I would think that it's worse you didn't tell them about it, rather than the conviction itself.

I'm unsure of the current effectiveness of cross EU record sharing, in theory they should show up, but in practice it might not. In addition; it may be considered spent, so would not show up on a basic check.

HOWEVER if it does show up, you will likely not get the job because you failed to disclose it. Banks are particularly strict on both convictions, but also trust. If they cant trust you, there's no option to keep you on.

(some convictions automatically bar you from employment in the financial sector; I'd suspect cannabis isn't one - but someone with more knowledge might correct me)

If you've lived in Croatia for longer than 6 months in the last 5 years, and it is not 'spent', it will definitely show up.

I believe it will yes, otherwise someone with for example, a record of sex offending in Croatia could come over here and be a teacher. I think the only exception is when an offense wouldnt be illegal in the UK, but clearly intent to supply drugs would be.

This is the site I was looking at:

I'm afraid that is not true. There are various levels to a DBS check including an 'enhanced' check where your employer may have the right to find out additional information including your suitability for working with children or vulnerable adults. Sex offences would clearly show up on an enhanced check for a role working with children. Unfortunately a standard check may not pick up certain 'minor' crimes from a different country.

OP do you know if your check is 'enhanced or not'.

As a DBS , CRB holder you are required to inform your employer if you have subsequently broken the law. This as mentioned could come back to bite you.
  • I do know what you mean but I just didn’t think would show as I have not commit a crime in the UK.

They really do trust me here having worked here for numerous years - so I could be made to look a proper idiot if this comes back.

It’s currently at vetting process - I’m quite sure if it does come job they will reject my job offer. But I’n just hoping I can try explain circumstances and see what will happen.
  • It’s basic check! Thank

When did you get the conviction? Think that will give you a better clue if it's likely to show up or not

Ah, in that case you're lucky it will have been spent by now in all likelihood.

The DBS treats convictions as spent or unspent under UK laws.

The fine was spent 12 months after sentence.

The suspended sentence 12 months are the duration of the sentence. So assuming it was 3 years or less, you're fine.

    - This is on the presumption that it really is a basic check

I don't suppose you pay the £13 a year for it to be on the update service (I'm guessing not as your employer would have then seen/not seen changes on your certificate).

If you are subscribed to the update service then an online check can be used to check the certificate and you can breath easy as your employer hasn't mentioned anything for the last 4 years since your conviction.

I carry out Enhanced DBS checks regularly for people from all corners of the planet. There is inconsistency to what country shares what information and not just because it's EU or not.

A basic check will then not include the pova register etc and as far as I understand (I don't carry out basic checks) the matter does not go to the police for more in depth checks. Instead DBS check the polices national computer database to see what shows up.

Don't take this as gospel but I think you will be fine.
Whether you should have informed your employer is different mortally speaking. At the end of the day if they check and it's clear then you have done nothing wrong.

You can pay £25 to request your own basic DBS check and see if it shows up for your own piece of mind before your employer does. https://www.gov.uk/request-copy-criminal-record

The different types of DBS check usually relate to spent/unspent convictions (some convictions will never be unspent however), and for specific job types (working with children, or children/adults in a care setting, gaming licences).
