Capital1 rejected but offered Pelvin

Hi, just claimed on Capital1 and was rejected but advised that under Pelvin they owe £570.95
and call this 'a redress payment' The cheque came same day as rejection letter. It does not say that accepting this means we can't go any further BUT if we cash this can we still go to the ombudsman to take the claim further? thanks.

    Plevin only applies to rejected complaints. So, what they have done is correct and normal on a rejected complaint.

    You can still go to the FOS if take the Plevin payment. If the FOS overrule the rejection then the Plevin payment is deducted from the redress.

    As mentioned in another thread - I have just had a Plevin payout myself.

    EGG (now Canada Square) rejected my claim, and have said they’ll send me a cheque for £1,200 under the Plevin ruling.

    I have about half a dozen credit card PPI claims going through at the moment, so it will be interesting see how they all pan out!

    I guess it’s better than nothing!

    I too have a Capital One claim going though, so I will let you know how I get on with them!

  • hi, they said that telephone call when the PPI was activated was an inbound call and the criteria for PPI eligibility was met - the call was inbound as I had to call them to activate the card and that's when I was told if I didn't take the PPI i couldn't complete the activation, unfortunately this didn't strike me as odd at the time.

    How are you going to prove your (very specific) accusation at the Ombudsman?

    I doubt there will be any recording of that call and the Bank will provide the Ombudsman with sales scripts which contradict your version of what was said I'm afraid. If you didn't want the PPI, why didn't you subsequently cancel it?
  • catch 22 - there's no real way I can prove it - the bank have said that they have no recording of the call and said 'we would've reconfirmed the eligibility for PPI' their rejection is based solely on my eligibility for PPI and not, as I told them, how I was pressured it to having it. Once I was aware that PPI was not a good thing for me I did cancel it, but at the time of taking out the card I was advised that without PPI the card would not go through.

    In the absence of any evidence that you were "pressured", the Bank can only look at your eligibility.
    This is the exact same approach the Ombudsman will take I'm afraid. Sales scripts from the time will be produced for the adjudicator which contradict your version of the conversation.

    As you say, "Catch 22".
