Deposit protection scheme

Are the dps useless or what? Been trying to get a deposit back to part pay for rental arrears for which the ex-tenant actually provided a signed letter, handed to over to my solicitor. over 5 months ago & still nothing, despite numerous emails!

Rang them today to finally get hold of someone to speak to & was told 'we are snowed under so probably not had time to access your emails to reply & you'll need to wait till we get time to authorise your claim!!'

Has anyone had such a bad experience with them too?

I get there are bad landlords out there, but there are just as many bad tenants too & the law nowadays seems to always side with the latter, no matter how rogue they are!!

The law isn't siding with them, BUT emailing them and starting a claim are two different things. Claims are on specific pathways, so once started will be resolved with-in X amount of time.

That can vary if there is or is not a dispute, but 3 months is the upper limit as far as I know. (only been through it once with the custodial scheme)

You shouldn't need to email as they have a webportal for these claims.

I have gone thru the correct & necessary steps via their web portal, etc. My point is, as you indicated, I thought there was a 12 week time limit & if the tenant has not disputed the claim, they'll automatically refund the deposit to the landlord. But, they're not even doing that, despite following procedure correctly. It makes you wonder why they're there in the first place

In the future you could use an insurance backed scheme?

But I do agree that is a long wait if you've followed all the correct steps. Remember that the scheme are making money by holding on to it.
