Hi All. I got a PCN from Premier parking and having read the newbie thread l sent a letter appealing the PCN using the template on the newbie thread, see bellow:

Re PCN number: 0000000
I appeal and dispute your 'parking charge', as the keeper of the vehicle. I deny any liability.
There will be no admissions as to who was driving and no assumptions can be drawn, nor was there an agreed contract. Your signage terms fail the test of 'large lettering' and prominence of the parking charge, as established inParkingEye Ltd v Beavis, which is fully distinguished.
Should you fail to cancel this PCN, I require with your rejection letter, all images taken of this vehicle & the signs at the location that day. Do not withhold any images or data later relied on for POPLA/court.
Firms of your ilk were unanimously condemned in 2018 as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised too; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and say on camera 'we make it up sometimes' (BBC Watchdog).
I will be making a formal complaint about your predatory conduct to your client landowner, as well as complaining in writing to my MP and ensuring that they are appraised of the debate where Parliament agreed unanimously: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''.
Formal note:
Service of any rejection letter/POPLA code and/or legal documents by email is expressly disallowed. All responses to me from this point on, must be made by post. Regardless of any MCOL online/email system, service of any court claim must only be made by first class post to the latest address provided by me.

We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:
We must therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable UK postal address. If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN. This information should be provided by 14th September 2018. Please note, Premier Park Limited will not reply to any correspondence until after the above date, if the requested information is not provided.
If we do not receive this information by the date given, the registered keeper of the vehicle at the date of event will be held liable.

Assuming you intend fighting this and you are dealing with premier parking then read up in the newbies FAQ thread near the top of the forum on popla appeals as that will be your next step

Please make it clear to us as to who exactly you are dealing with. Your thread header states 'Premier Parking' (and I think Quentin has based his advice about IPC operators on that), yet you seem to have a reply from Premier Park (who are BPA operators), in which case advice will be very different.
You need to be absolutely accurate in giving us information in order for you to get the precise and correct advice to help you fight this.Please note, we are not a legal advice forum. Please start by correcting the name of the parking company in your thread title, and in the text. You have already managed to confused at least one of the regulars by quoting the wrong parking company, and have received incorrect advice as a result.
It is Premier Park Ltd. There is another company called Premier Parking Solutions and the advice on how to deal with them is different.
To start with, the scammers are lying. There is no "must" about revealing the driver's identity, and there is no such requirement in the POFA 2012. You should complain to the BPA, DVLA, and your MP about this misrepresentation of an act of parliament. They can request, but they cannot insist, which the word "must" implies. Their comments are meant to deceive in order to obtain monies.
Of course you ignore their letter and await your PoPLA code. Once you have that, you should construct a draft PoPLA appeal using all the template points available to you from post 3 of the NEWBIES, then post it here for checking before you submit it.

PP always do this, and clearly the letters says they will then hold the keeper liable, and clearly a rejection letter will follow.
