Currys Whatever Happens!!

Hi,
I purchased a TV from currys in 2005 and took out the Whatever Happens Insurance, well recently my 6yr old boy fell into the tv and cracked the screen i rang Currys to explain that my 6yr old boy fell into it cracking the screen, they sent out an engineer to visibly look at the Tv and then said "yes it will need a new LCD" they said they will be in touch a week later to collect the Tv for repair all was good, as promised a week later they took the TV and said it should be back within a week, this was 2weeks ago, this morning i recieved a letter saying they are returning the TV un-repaired as the insurance doesn't cover neglect! how can my boy falling into it be neglect!!!
They have gave me an address to write to, to appeal, anyone have any ideas what i can write back? i'm useless at writing letters, or what further action i can take.

Forgot to say, on the back of the agreement it states repair against Accidental Damage! well he didn't purposely fall into the TV

No but they will probably argue a 6 year old boy shouldnt be able to fall into a tv screen in the first place
Id appeal and you'll probably win anyway as they cant prove it was neglect
If you cant be bothered with the hassle claim on your home insurance0 -
Thanks for the reply, i will appeal as i have nothing to lose, unfortunatly i dont have house insurance so cant claim on that policy.0

I think its always worth mentioning in your response, in a case such as this, that you will inform the FSA, to whom they will be responsible.
It seems absurd not to determine a six year old falling into the set as being accidental, ( allowing for the fact that they appear to have accepted your version of events).
But, even apart from that, although I'm not familiar with the cover myself, I'd say that calling an insurance policy "Whatever Happens" and then refusing to respond accordingly, sounds like a top grade example of mis-selling!!0 -
I would argue this all the way.
Assuming that they are saying that you have neglected to protect your property from damage, they are wrong. The FOS is quite clear on when and how insurers can invoke 'reasonable care' clauses and the policy holder must have been shown to have been reckless for it to stick.
Ask them to register an official complaint. They'll need to issue you with an acknowledgement within 5 days and a full response within 8 weeks.0 -
Thanks for the replies, i will be appealing as i have nothing to lose.
I just looked at the picture currys sent me with the damage, and at the bottom of the screen on the actual casing there is a mark that wasn't there when they took the TV away, also the cracks on the screen are far worse, luckily i took a picture before they took it away and the damage isn't half as bad as it is in the picture they sent, so whether this happened in transit or not i dont know? even the invoice from the courier the only damage they state is to the screen and luckily i have my copy of this as well.
In the meantime me appealing, if they return the TV to me and it is in worse condition than when it left me, can i refuse to accept it? or what are my options?
Also can anyone give me some ideas for a template letter to send to them please?0 -
i got a george foreman grill last xmas, the thing was overheating and the coating taken off and no end of trouble .... local shop got called and idiot and they started to refuse a refund even though we had reciept it was pathetic0
