Plus, even in an alternate universe in which four of them clubbed together, bought the share of brother 5 and let brother 6 live there rent-free, this is not a solution, this is kicking the can down the road.

Eventually one of the four would want his money out, just as brother 5 does now. So the same problem, only worse, as a) a larger sum needs to be raised by a smaller group b) brother 6 is older and less likely to cope with a move.

Just to play Devil's Advocate let's look at it this way.

Twenty years after the death of your Mother 5 of the 6 beneficiaries of her not inconsiderable estate have received absolutely nothing, whilst the sixth has been living rent-free in a house he only has a small stake in. What would five-sixths of the monthly market rent for the property be, multiplied by 240? 100 grand? So the rest of you have nothing and he's laughing all the way to the bank, no wonder he doen't fancy moving.

Your brother is only doing what should have been done years ago and sort this mess out.
  • You are missing my point. There are all sorts of things to be considered such a CGT, the effect on benefits etc. Etc. The family would be foolish not to get professional advice rather than relying on this or any other internet site. The world is not as black and white as you are suggesting particularly where families are concerned.
