Accident not my fault - need advice

Hi everyone,

So a couple of days ago i got into a little bit of a pickle. As i was driving down a road, a parked van suddenly lunged into my car. Upon further inspection it seems that the van was loading and forgot to apply his handbrake. The guy admits everything but heres the problem.

The guy really does not want to go through insurance, i understand his point of view since commercial van insurance is extremely high once a claim has been made. It has happened to my dad before so i know.
My car is a 2006 bmw 320i, the car is worth around 2200 give or take. The repairs however will lead over a grand at least.

My question is, is it all right for the other party to purchase my vehicle as if it was not damaged for market price. Will i need to inform my insurance or any legal issues?

    You should tell them about the accident but in doing so you'll screw over the van driver.

    When you get another car, I take it you'll intend to commit fraud when taking out insurance.
  • You need to tell them what happened and that you are choosing to resolve it privately. Not telling them would be fraudulent and you cannot guarantee that the other driver won't tell his insurer anyway. Cancelled insurance will cost a heck of a lot more than anything you might gain by keeping it quiet. Don't do it.

    As others have said, you need to inform your insurer regardless.


    You can let them deal with it (at no risk to you), or take a risk and do a favour for - and trust - a complete stranger. A stranger who is happy to defraud his own insurer.


    Your choice.
  • Thanks for the advice guys, I have reported it to my insurance and have let them deal with it. The guy was a sole trader type of business so i did feel a bit sorry for him but i guess his premium increase will be a lesson for him.
