CEL Witness statement

Hi I have had a claim ongoing with CEL since August last year I didn’t respond to any of the solicitor letters or any correspondence and I filed a defence a few months ago. A few months later CEL filed their questionnaire late. Now I have received witness statements and they are offering me the chance to pay £100 and have it settled. What should I do? I’m clueless about this stuff

    Read the second post of the NEWBIES thread, please. PLEASE read it first.

    And double check the letter telling you about your court date (if you have that yet) as it tells you the date by which you MUST file & serve your own WS and evidence.

    Have you got a court hearing date? If so, what's the date given to get your evidence and WS in, then?

    Or are you not at that stage yet, and CEL have merely mocked up a WS and sent it with a £100 demand to put pressure on you?

    You say you are clueless, so read the second post of the NEWBIES thread, and please don't expect us to retype or copy here, what's already there. No saying 'waaaah, there are some WORDS' or 'waaah, the NEWBIES thread is too complicated'. No, it isn't.

    Good, we've seen this before from CEL. It's desperation, designed to confuse and I am sure some victims rush to pay the £100.

    Might be fun to reply and tell them to save money and cancel now - I WOULD.

    We see people pay nothing because we KNOW that CEL have quite possibly no intention of proceeding or paying the hearing fee, and will discontinue.

    How come this is so slow, have you had a letter from your local court yet or are they fighting a huge backlog, might be worth asking them whether the Claimant has not indicated that they are proceeding, and if not, write and ask the local court to strike the claim out.

    Several months and no hearing date yet is odd, IMHO.

  • Looks pretty solid though. They have included a picture of the signage where the contravention took place. Robbing b****rds they are.

    Do you think that would be the best way to proceed? At this point, after all the hassle, if theres any chance for this to actually proceed to a hearing id happily just pay the £100
  • I did receive some correspondence from the court re a potential hearing date, but no solid date as of yet

    What type of 'correspondence from the court?' Was it a letter or was it an official court form? Do you still have it?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I don't think you've quite understood what I said. We've never lost a CEL one.

    Wise up - this is the very easiest PPC to beat, and not even a hearing is likely!

    You need to read it. If it gives a hearing date and in the blurb, talks about both partied having to file & serve the evidence/witness statements by a certain date, then you must still do that in time.

    Read that letter again, it is important to know what it tells you in the small print on the back, about what you have to do and by when!
    This seems to have gone further than most of the examples in the newbies thread.
    No it hasn't. Search this forum for the words CEL discontinued or CEL discontinuance and you will find they take it beyond WS/evidence stage now, and THEN they discontinue, close to hearing dates.

    you also need to post the draft defence you submitted on here, minus references and personal info etc , then we know what the defence said

    it would also help to know what their POC said too

    dropping an SAR bomb on them under the GDPR may also be a good idea too
