    You do not have to say anything. But, it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence.

    But that only applies if the insurance co gets seriously p'd off and reports you for fraudulently claiming that chargeback.

    Both you and your sister are technically guilty of fraudulent misrepresentation. So far you've made a £570 profit. Don't you realise you've done something wrong?

    Question. Don't insurance companies ask questions about previously cancelled policies?
  • However £275 for 4 weeks cover does sound high even if mentioned in terms and conditions and lets be honest how many of us actually read all the terms and conditions and out of those who will say yes they do,how many actually understand them.
    Id say not many as my broker has even stated she doesn't understand half of them....yes thats a worry but id assume the under writer would lol.

    I think one thing that is being missed on the 875 vs 570 for one month, is that 875 was for 1 years NCD. I suspect the calculation went:
    - 1y NCD = 875
    - But - actually, its 0y NCD = ??? (probably a lot more)
    - (1/12 x 0y NCD) + cancellation fee = 305
    - Customer paid 875, minus 305 = 570 refund.

    As said - NCD is for the policyholder only, otherwise everyone could add themselves to parents insurance at 17, before getting a car at 20 claiming 3 years NCD.

    If in hers, I hope you/she declared that she has a cancelled policy. If not, your problems could be about to get a lot worse.
