    Update on these cases.

    Both have been transferred to local court after I declined mediation. I have received two separate responses which are detailed below

    As I have previously mentioned, I was not the driver on both occasions. There is some variation in the two cases as it seems one time a payment was made but overstayed, another time no payment was made.

    Two things I have noted - on case 1 when a payment was made, B W Legal state (point 6) that I purchased a ticket for two hours between 16:49 and 15:49 but parked until 16:49 (!!!!)

    Secondly on case 2, they have the temerity to complain that "my defence is a generic template defence readily available online and does not provide any genuine defence to the claim issued against you. We are disappointed by this conduct and it certainly does note explain the true reasoning behind your breach of our client's terms and conditions"

    My friend is a solicitor and was horrified by this statement, and suggested it was close to bringing the legal professional into disrepute to respond in such a dismissive way to a letter. Even worse that they mocked the 'template' nature of my response, after 6 months of template letters from them!

    So that's where things stand. I have followed your advice to the letter. I would appreciate any guidance to the next steps.

    You might want to take those photos down until you have redacted them and removed your personal information. You also might want to look into having both cases heard at the same time. Search the forum for how to do this.

    We are always horrified by their conduct, but that dismissive letter is normal for these scumbags.

    You ask the court ot do it
    You cannot demand it

    Just an update. I was all set to fight this claim, but had a letter today from BW Legal saying their client has sent a Notice of Discontinuance to the court.

    Not sure whether to claim for loss of earnings now!:beer:

    Bullies back down in the end.

    Yours is the second one reported as discontinued this weekend from the latest avalanche of BWL claims for hitherto court-shy PPCs (which include NCP and Britannia as some of the 'biggies').

    Early indications that this is nothing more than a debt collection strategy, where those who put up a stiff fight (via a strong defence) will see their cases discontinued - albeit having been put through major work to get there!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
