Buying House From Family Member Without Estate Agent

My Dad is selling his holiday flat which I've decided to buy and move into on a full time basis.
I'll be getting a mortgage.
Since the estate agent didn't have any involvement with finding the buyer (me) we would like to remove them from the equasion so my dad doesn't lose any money to fees.
How can we complete this purchase without an estate agent?
Clear steps please :cool:

    Did you Dad sign a sole selling agreement or a sole agency agreement?


    step 1) Ask your Dad to check the estate agency agreement he signed.

    Would it help if he took the flat off the 'market' before selling to me? Then the agreement with the estate agent (whatever one he has) wouldn't be in force.

    Yes - if it's a 'sole selling rights' contract, it would be best to terminate the contract before moving forward with the purchase.

    It shouldn't matter so much with a 'sole agency agreement'.

    But most EA contracts have a minimum contract period - sometimes 10 or 12 weeks (sometimes more). So your Dad might have to wait until that period is finished.

    Ask your Dad to contact the estate agents for a written list of those they have introduced the flat to in case they come after him in the future
