My wife has just received a PCN from Parking Eye for £70 for parking at ASDA Oldbury for what they claim is 11 hours 44 mins from 2039 to 0823 the next morning. The car did go to the shop on the day in question and a purchase made and my wife returned early the next day to make a return. So whilst we agree that the car was there on both occasions they seem to have missed her leaving and arriving next day. I have taken a video of my computer screen showing my Ring door bell account which clearly shows the car arriving at my home at 10:04pm and the being parked on my drive at 07:56 and 07:58am the next morning and the car leaving to go back to the store
My questions are will Parking Eye accept this for an appeal and reading all the information on “Double Dipping” have they also contravened DPA and should I also refer this to the DVLA and ICO. I won’t waste my time contacting ASDA as previous experience shows that they ignore all complaints.
Any advice appreciated

Oh I would definitely complain to the store manger and/or the CEO of ASDA, pointing out in no uncertain terms this is why our MPs have said in open parliament that this is an unregulated scam, and the parking companies ae a bunch of cowboys.
I suggest you send the standard template appeal from the NEWBIES but add that you have video evidence of the car being elsewhere and will show this in court if they make a vexatious claim.
Definitely complain to the BPA, DVLA, ICO, and your MP. Local and national press might be interested as well.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

I hope that dash cam footage would be allowed as this would definitely knock the double dipping on the head.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Your video should have a time stamp as to when the file was originally created.
The courts accept / will consider video evidence, especially with a time code, it is very difficult to refute video with a time code
I would also add, after stating that you have video evidence, as to the location of the vehicle , if they send any threat o'grams you will seek compo under the Data Protection Act
I wish I could be double dipped would so love a nice bit of compo under DPAPrivate Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA0 -

There should be a zero tolerance of double dipping, company's that produce parking charges as a result of double dipping should face an immediate ban from accessing DVLA data, and those that allow double dip ppcs to operate on their land sound be made to refund anyone affected+costs+gdpr issuesFrom the Plain Language Commission:
