I won, hearing was on the 22nd October and judgement was set aside.

Have'nt had any letters from the court confirming this yet.

How long until the CCJ gets removed from my credit file?

My understanding is that the credit scoring agencies update on a monthly basis.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It will be removed shortly. But the claim is still 'live' and needing action by you once PE resurrect it.

Well done - but what about your £255 costs and extra costs for attending (did ParkingEye's rep turn up - if so, did they argue the toss?).

Did you make sure the Judge considered your Draft Order and is minded to reserve costs?
On arrival i was asked if i had was in a car after i answered yes the receptionist took my car registration. (Not sure what the receptionist did with it)
I REALLY think you need to sue the Gym for your losses if you end up £255 down (or more, if you also end up losing the case - which I would hope you won't, given the circs).

It is high time landowners, retailers etc. got more than complaints from victims, and started to be sued in cases like yours where they HAVE caused you loss.

I didn't even mention the costs and was the last thing on my mind, i just wanted the CCJ off my credit file - causing me a lot a grief with mortgages etc.

Parking eye didn't turn up - There argument was that every other facility in the Gym was free, APART from the medical center :S

Basically the Judge set the CCJ aside, but parking eye are still going to be on my case by the sounds of it. the judge swayed more towards the not living at the address part so no defense (CCJ Set aside).

But i wont be in a rush to contact parking eye about that, im hoping this now just goes away, i wont be parking on any car parks parking eye monitor either.

so the CCJ currently shows 'Active' - is this going to completely remove (which i hope!) from my credit file or go 'inactive'.

You have been treated abonibably by PE, complain to your MP.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. It has even been suggested that some of these companies have links with organised crime.

Watch the video of the Second Reading and committee stage in the House of Commons recently. MPs have a very low opinion of this industry.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by in the not too distant future..
You never know how far you can go until you go too far.

    It will be completely expunged.

The free credit agencies do take longer to update.

Check the trustonline website to see if it's gone (that gets updated immediately)

If it's still there contact the Court

PE will be informed and it's up to them whether or not they decide to try again

Good to hear it has finally been removed.  Did you have to provide evidence regarding the wrong address.  If so what did you use?

@cazbym, this poster has not visited the thread since November 2018 and is unlikely to see your question here.  You could try sending a PM or you could start your own thread if you have a specific question that is not answered in the NEWBIE sticky.
