ACAS Early conciliation - Compensation

I'm looking for some advice.

I feel I was unfairly dismissed from employment. I won't go into the ins and outs as it's not really relevant. On solicitors advice, I recently started the early conciliation process with Acas.

I have been asked to come up with a compensation figure to be put to my former employers but I'm not really sure how to come up with this.

I don't just want to pluck a figure out of the air, I want to be able to justify the amount but I'm unsure what can and cannot be included. Acas are unable to provide advice and I don't currently have a solicitor acting on my behalf as they advised me to carry out this Acas process alone and then contact them if this doesn't resolve the issue.

I was out of work for some time and also took a substantial salary cut in my new role which is something I want compensating for. When I lost my job I also lost company benefits such as shares and a company car. I'm not sure if I am able to include this?

Acas did advice that they wouldn't recommend attempting to claim for stress for anything like that.

I am just wondering if anyone has any experience or could offer any help with this?

Thanks in advance.

Why not ask what their offer is?

Unfair dismissal is rare but obviously does happen.

If you provide details posters can give you an indication of the likelyhood of success.

How long were you employed there for? How long were you out of work for? How much of a paycut did you take?

Should be fairly easy to work out:

    - The difference between old and new salary (the only unknown variable is how many months this should last for)

    - The loss of wages whilst in between jobs

    - How do company shares work? If they give them to you then surely you'd retain ownership after employment? Or were you paid a dividend (easy to work out)? Forgive my ignorance, I'm not sure how you can have shares and have them taken away?

    - Company car... Maybe, but given the car was for work use I would only wager a guess as to you being entitled to claim for costs relating to your travel to the new work, for x amount of months.

    - Maybe some "compensation" for ill-treatment.

I'd probably put a ballpark figure at 3-6 months of your old wage.

But then again I have next to no experience in this matter and you'd be best speaking to CAB/ACAS/solicitor and maybe trawling other posts for an idea of what you may be able to claim for. I could be completely 100% wrong, so take my post with a huge pinch of salt.

I think you should try and keep your objectivity and instead ask this question of yourself; how much will be enough to put things right here?

Employed for 8 years, out of work a month, took a 10k paycut.

The shares were part of a bonus scheme, could only be cashed out after so long and as this time period hadn't passed I lost them when I left the company.

Out of curiosity, what was the time period if you had been employed for 8 years previously?!

Were they share options rather than shares?
