Speeding fine charge

Hello

I posted this on a different board but they suggested I put it here.....

I'm new here but I wasn't sure where to post this. It's stressing me out so much so I thought I'd see if anyone could helo.!

Basically my husband got caught speeding on Saturday. I know it's bad and he shouldn't have been speeding, but basically going 91 in a 70 area & was pulled by a traffic cop. I googled it and looks as though he might be fined over £600 plus looking on!confused.com

I think this is a new law? As it used to be around £100. I'm so stressed about it. We are 1 parent working family I'm currently off wirh my son and if it is that much every last bit of our savings will be gone.!
I'm prepared to get some part time work in a pub or something, but obviously i don't have anything just yet.!

I'm so stressed about it I can't sleep properly. To know I have no kitty to fall back on makes me feel sick, we live to a small amount each month as it is.

Does anyone know anyone that's had one of these new speeding fines and if so are they seriously a certain percentage of the wage etc etc?!

I hope someone can help, I've asked around friends but no one has heard of this new system and not been caught on it.!

Many thanks

Best just let it run its coarse as there isnt much you can do about it.

He just needs to drive within the limits of the law in order not to get further fines. If he can give them a statement of expenses they may offer a payment plan - worth a try.

For that excess he is likely (if eligible) to be offered a fixed penalty notice (£100 and 3 points).

Does he have any points on his license at the moment?

    There are no new laws.

All that happened in April 2017 was that the Magistrates' sentencing guidelines for the most serious speeding offences which are dealt with in court were changed slightly. There are three bands of seriousness (depending on the speed recorded) and only the top band was changed from a guideline fine of a week's net income to one and a half week's net income. The reporting of that change (with mention of "new laws") was sloppy and irresponsible.

As above, providing your husband has fewer than nine penalty points on his licence the matter will not go to court. Instead he will be offered a fixed penalty of £100 and three points. (That is the usual offer up to 95mph in a 70mph limit). Make sure when he receives the offer that he pays promptly and that he sends his licence in. Many drivers fail to do this, the FP offer is withdrawn and they find themselves in court.

Whilst I'm not going to comment on the issue of your OH's driving, the Pepipoo forum is the best place to air this - they do have a good record when it comes to dealing with traffic penalties.

Sign-up with something other than a Hotmail addy, and ensure you read the preliminary info before posting and post in the correct forum - plus be ready to provide all the info they ask for eg a depersonalised scan of the NIP and any other documentation.

If he can be helped, they are the guys to do it.

There's not much more help to be given (unless he disputes the speed alleged). There are no issues with the NIP (as he won't get one - he was stopped at the roadside) and the Fixed Penalty is the best offer he will get.
  • Thank you for the helpful comments.

My husband doesn't have any points, No.
He doesn't normally speed we were in a stressful situation on the way to something. No excuse I know and he feels very bad, but I'm so grateful for the helpful comments. It's helped to put my mind at rest.

The above (as answered on your other post)

Yes, unfortunately the way the changes to the sentencing guidelines were reported by the press and media in general was very misleading and sensationlised and has resulted in a number of similar threads being started on here and elsewhere.
