MBNA PPI advice

Hello I'm new here :)


Just after some advice on MBNA complaint please....


I was just 18 when I took out a credit card in 1995, genuinely do not recall any discussion about PPI, never spotted it added to my statements until maybe 2003/2004 when I called them up and told them that I want it removed, never wanted it, happy to accept the risks, etc, they cancelled it but I made no formal complaint at that time - didn't question whether I'd been mis-sold just accepted I'd been naïve. At the time I took the card I was FTE in financial services with full sick/redundancy benefits (and I still am).


Last year I contacted MBNA to have them confirm that I did have PPI, which they did and they invited me to make a complaint which I have only just got around to. But now I am confused about this 3/6 year rule. I have no idea how this applies to my situation since I did not know that my work benefits would have made the PPI useless for me, I only just figured this out. I have submitted the claim today using their online service.


What is the likelihood of getting anywhere with this complaint?
(I still have the account/card open, and have not received any letter telling me I have 3 years to make claim)

    For MBNA, it is 3 years from when they invited you to complain. Forget the 6 year rule side as it has to be both sides to matter. (i.e .more than 6 years from sale and more than 3 years from being reasonably aware). MBNA are known to have sent out letters and that is the trigger for the three year clock. If no letter was sent then the timebar wont apply.

    I think it's the 3 years "reasonably aware" bit that worries me. I guess I'm expecting them to claim that when I cancelled in 2004ish, this was the point that I was aware I'd been mis-sold - I remember I was quite annoyed when I realised what I'd been paying as I have never asked for it/agreed to it, but not at all aware that my work benefits specifically made it a void policy, and not aware of my rights to formally complain.


    But hopefully the fact that their last communication to me confirming I did have PPI since 1995 which included details on the process for complaining means i'm not yet timebarred!

    If they check their records and find out you cancelled it back then they will almost certainly time bar it as cancelling the policy is sufficient to trigger the 3 year rule.

    An amount the Bank would be unlikely to risk having to pay the Ombudsman fee for, so never in any danger of being time-barred.
