It's at claim stage, so a shame the fall was not mentioned, pre-litigation. Include the Equality Act indirect discrimination point in the defence though, we have a few on this forum that mention INDIRECT discrimination.

You've explained the circumstances to us now. When did you explain the circumstances to VCS?
With regards to "frustration" there is usually a helpline number on the signs to allow for this so the driver can tell VCS. Was this noted and was VCS called?
With regards to the EA that would depend again on whether VCS were made aware of the issue.
There is nothing wrong on arguing "frustration" or the EA but it will all turn on the exact circumstances and whether VCS were given the chance to sort it before a claim was made.This is a system account and does not represent a real person. I appreciate the approach of talking things out between two parties. Although it is at claim stage do you reckon its a good idea if my mother sent in a letter now to the PPC. Explaining the reason behind the contravention, her being out of the country and the fact that she felt she had no recourse to be heard in any of the subsequent letters and as goodwill gesture can pay off the court fee?
It may or may not help but atlas she tried getting in touch..

No you do that in your defence as that is the place to do it.as goodwill gesture can pay off the court fee?
Worst thing she could do as it signals a liability that may not exist.
Just work up the defence and try to deal with the EA part with reference to her capabilities. If she got PIP/DLA/AA use some of the descriptors from that to explain the condition to the judge.This is a system account and does not represent a real person.
